Jailed Vet Files for En Banc Hearing

Wisconsin Navy Airman Keith Roberts (1968-71), a Vietnam-era veteran, [see Wisconsin Navy Airman Keith Roberts and U.S. Attorneys Scandal–Milwaukee] jailed for receiving U.S. Department of Veterans Affairs (VA) benefits filed a petition for an en banc hearing before the Court of Appeals for the Seventh Circuit this week.

Roberts was indicted, tried and convicted on five counts of wire fraud for receiving VA disability benefits though he had been diagnosed with Post Traumatic Stress Disorder (PTSD).

The indictment and conviction remain highly controversial because of the perceived flimsy nature of the allegations and the widespread criticism that the VA has received in its treatment of veterans.

The questions presented for review in Roberts petition are as follows:

A. Whether it is a denial of a veteran’s due process rights to require him to answer a criminal indictment alleging the same misconduct which served as the basis for the denial of veterans’ benefits, where the appeal of the decision of the Department of Veterans Affairs is still pending before the United States Court of Appeals for Veterans Claims.

B. Whether the Seventh Circuit Court of Appeals erred in concluding that the evidence presented at trial was sufficient to sustain a conviction for wire fraud, when the government had failed to establish, beyond a reasonable doubt, the necessary elements for such a charge.

C. Whether the Seventh Circuit Court of Appeals erred in finding that Mr. Roberts’ right to due process was not violated by the government’s withholding of material information.

Pardon Jailed Wisconsin Veteran

President-elect Barack Obama has tremendously more on his plate than reinventing government and restoring some semblance of accountability to Americans.

Ensuring that the world does not enter into a second depression, halting a war or two, saving the environment, formulating an industrial policy on alternative energy, one can go on; all are problems of a massive scale.

But readers of Uppity Wisconsin may notice a comment from a veteran posted this week about another veteran who is serving a four-year sentence in federal prison.

That jailed veteran is Navy Airman Keith Roberts (1968-71), a Vietnam-era veteran, [see Wisconsin Navy Airman Keith Roberts and U.S. Attorneys Scandal–Milwaukee] from Gillett, Wisconsin; and he’s an innocent man wrongfully imprisoned.

Roberts was convicted on five counts of wire fraud for receiving U.S. Dept of Veterans Affairs (VA) benefits after the national VA office launched a vendetta against Roberts for being a pain to the VA regional office in “tenaciously pursuing a claim for VA benefits" (Harper’s).

U.S. Atty Stephen Biskupic's office took up the VA’s case that resulted in the 2006 conviction.

In sum, Roberts served his country and was railroaded by a corrupt VA and an appalling U.S. DOJ.

President-elect Obama should grant an extraordinary pardon that will not only serve the cause of justice but will also repudiate a VA that has become outright hostile to veterans.

U.S. v. Roberts
The title of the case is fitting for this honorably discharged veteran diagnosed with Post Traumatic Stress Disorder (PTSD).

The crux of the case against Roberts is that Roberts was not friends with his fellow Navy airman (Gary Holland) when both the men were on line duty at a Naval base in Naples, Italy on February 5, 1969 when Holland was crushed to death by a C-54 aircraft.

The prosecution also says that Roberts exaggerated his efforts to save Holland, which constituted fraud for which Roberts was convicted by a jury in northern Wisconsin. And that Roberts therefore lied about the friendship and the effort to save Holland.

Holland and Roberts did not have a friendship, and Roberts exaggerated his efforts to save Holland. That’s the alleged fraud, that’s the intent to engage in fraud? Yes.

In fact, the two men had parallel service histories that would make it unlikely that Holland and Roberts were not at least friendly in their relationship, and that contradicts the prosecution’s indictment and trial statements.

So what happened, why the prosecution on such a slender reed?

"[T]he only reason Airman Roberts was ever prosecuted was because he was a ‘belligerent ass’ who kept insisting that he get paid back to discharge. He was demanding an appeal in Washington," said a background source at the Clement J. Zablocki VA Medical Center in Milwaukee who e-mailed the Lee Rayburn radio show in Madison in early June 2007 after a program about the Roberts case, and asked to remain anonymous out of fear of losing his job. "I'd have to say that you guys are TOTALLY (uppercase in the original) right about Roberts' conviction being bullshit ... ."

Said Roberts’ attorney Robert Walsh, a combat Vietnam Army veteran, at the oral arguments in October 2007 before the Court of Appeals for the Seventh Circuit, referencing this VA standard for judging any first-person account by veterans of what happened to them during their service:

… I submit to you that they are inconsistencies in every veteran's record, combat or peacetime. And that Congress has recognized that. And that’s why VA benefits is a very paternalistic, claimant-friendly, non-adversarial system. It’s even more paternalistic that the Social Security benefits adjudication system (per the Veterans Judicial Review Act). So, where’s the intent (for fraud)?
Good question.

Roberts criminal case is before the U.S. Court of Appeals for the Seventh Circuit (U.S. v. Roberts, U.S. District Court for the Eastern District of Wisconsin) where Roberts is seeking an en banc hearing, and his benefits case is on appeal before the U.S. Court of Appeals for Veterans Claims (CAVC).

A three-member panel for the Court of Appeals for the Seventh Circuit in July found that, "The record might also have supported a jury determination that Mr. Roberts sincerely believed that his statements were true and that he had no intention to defraud the Government ... (but) (i)t is beyond our authority to disturb (a guilty) finding on appeal (in this case)."

As for the comment by the veteran who served with Roberts in Italy, it corroborates what Roberts has claimed for decades had occurred:

James W. Ervin PH3 (not verified) on Tue, 12/16/2008 - 4:13pm. I was stationed @ NAF (Naples), Italy at the time of this "incident". July 1968 thru Nov.1969 . I also remember the young sailor be trapped / crushed up inside the wheel well (nose) of the aircraft inside the hangar of NAF naples,Italy. I do remember someone wanting to drive a forklift into the side of the aircraft ; but an officer or someone of authority would not let them do that....so what they did was have men climb up into the plane & go to the rear of the plane to put weight in the rear of the plane to let the nose come up to release the trapped sailor. (Unfortunately) that process was too slow to save the sailor from death. I also remember taking photographs of the " Pin " that was in the nose gear at the time. I remember it as being a homemade looking pin without a locking clip to keep it from being removed without unlocking the device. As for the names of the people involved , I don't remember ; but there definitely was someone there who wanted to use the (fork) lift to rescue the sailor from the collapsed nose wheel and was ordered NOT to use the fork lift. Sincerely ,
Roberts' family and fellow veterans supporting him in his case remain hopeful, but desperate.

President-elect Obama should grant this family a full pardon and make things right.

Veterans Day 2019 — Wisconsin Navy Veteran Proven Innocent; But Not Yet Cleared of Wrongful Conviction

Wisconsin's Keith Roberts
is a veteran whom we
betrayed and is a man
who will never be made
whole by what baleful
U.S. officials acting from
base motives inflicted
on an innocent man
from northern Wisconsin.

First in a series this week on wrongful conviction of innocent veteran

Updated - Madison, Wisconsin — Decency and duty drove a Wisconsin Navy veteran to act in an unsuccessful attempt to save a fellow airman from being crushed to death by a 73,000-pound C-54 transport aircraft at a Naval airbase in Naples, Italy on Feb 4, 1969.

The Navy veteran is Keith Roberts of Gillett, Wisconsin, (Mal Contends).

For his service and good work, Roberts was prosecuted by the United States Dept of Justice in one of the most despicable miscarriages of justice my state has seen.

While Roberts filed a disability claim related to his PTSD condition, citing in-service 'stressors,' that was being adjudicated at the Veterans Benefits Administration (VBA), U.S. Attorney Steven Biskupic (2001-2009) stepped in and subsequently secured an indictment on mail fraud on April 26, 2005 under Title 18 United States Code 1341 (mail fraud), later superseded to wire fraud, (Wisconsin State Journal).

Roberts was convicted of wire fraud in 2007 for receiving disability benefits related to PTSD, diagnosed by several public and private medical professionals. The federal indictment was malicious and baseless, (Wisconsin Navy Airman Keith Roberts, U.S. Attorneys Scandal–Milwaukee, EpluribusMedia, Wis Community).

The indictment reads in part that Roberts was not friends with his friend, Airman Gary Holland, and that Roberts "exaggerated" efforts to save his friend when the Navy air base equivalent of a general quarters alarm was sounding as an air man was being crushed to death by the C-54 aircraft. Consider this.

Reads a U.S. Department of Justice, United States Attorney’s Office Eastern District of Wisconsin press release from March 5, 2007:

Roberts was an airman stationed at the Naval Air Facility in Naples, Italy, in 1969. The indictment alleged, and the government proved at trial, that Roberts fabricated his role in the attempted rescue of an airman who was killed at the Naval Air Facility on February 4, 1969. Roberts also fabricated his relationship with that airman.Roberts was discharged from active duty in 1971.
The DoJ indictment is demonstrably false, but even granted its silly assertions and premises is absurd grounds for a federal criminal indictment.

This Wisconsin veteran's fight for exoneration of this political prosecution continues on this Veterans Day, 2019.

Contra the government's case, writes human rights attorney Scott Horton in Harper's Magazine (Sept 7, 2007), "The prosecution smacks of retaliation and a plan to suppress veterans claims—Roberts was prosecuted for tenaciously pursuing a claim for benefits, which VA resisted and which is still in the benefits review process."

The Vietnam-era veteran had no idea while he was gathering evidence seeking an earlier retroactive date for his successful VA claim in 2002, per the advice of a Shawano (Wisconsin) Veteran’s Service Officer, and jumping through hoop after hoop, that not only were his existing VA benefits in jeopardy but his very liberty was in danger.

"The process of gathering evidence to prove PTSD disability is extremely time-consuming," said then Sen. Barrack Obama (D-IL) on August 10, 2005 at a time when the VA was set to review 72,000 PTSD cases, but backed down under intense pressure from veterans. "It requires the compilation of medical records, military service records, and testimonies from other veterans who can attest to a person’s combat exposure."

As Roberts was adjudicating his claim with the VA, after Roberts had accused the VA of fraudulently handling his claims in 2003, U.S. Atty Biskupic, in an extraordinary development, stepped in in 2005 and launched this extraordinary prosecution.

Critics see Roberts as an innocent victim—a poster boy and cautionary tale—of a VA bureaucracy determined to deter PTSD claims from Vietnam vets, rightwing forces allied with VA Secretary Jim Nicholson (2005-07), and an overzealous prosecutor, Biskupic and his staff.

This week, these pages will feature exclusively new developments of a man who served our country honorably; followed the advice of his veteran service officer, and was subsequently chewed up, imprisoned and effectively tortured in federal prison.

A three-member panel for the United States Court of Appeals for the Seventh Circuit (07-1546) in July 2008 found that, "The record might also have supported a jury determination that Mr. Roberts sincerely believed that his statements were true and that he had no intention to defraud the Government ... .
---
The U.S. v. Keith A. Roberts indictment on mail fraud (April 26, 2005), [superseded by the indictment on wire fraud,] alleges in part that Roberts in his "(s)cheme to (d)efraud" the VA "falsely represented material information to the VA" including "that Roberts and airman Gary (Holland) were close friends and roommates."

In fact, an analysis obtained from Roberts' wife, Deloris Roberts, of the service histories of Gary Holland and Keith Roberts reveals parallel military careers that would make it unlikely that Holland and Roberts were not at least friendly in their relationship, and that contradicts the prosecution’s indictment and trial statements.

These service histories are readily available to any federal investigator probing the case. But the enterprise of judging the friendship between two airmen 35 years later is the basis of a federal indictment?
--
In February 2010, U.S. Supreme Court Chief Justice John Roberts questioned Assistant to the Solicitor General Anthony Yang in oral arguments in the federal benefits-related case, Astrue v. Ratliff.

Asked Justice Roberts, "In litigating with veterans, the government more often than not takes a position that is substantially unjustified?" (p. 52, United States Supreme Court)

Yes, he was told.

Roberts found this "really startling."

So, please, stay tuned, what I will present in these pages this week is really startling.

And Happy Veterans Day, Keith Roberts.

We know what our government did to you and your family.

"[T]he only reason Airman Roberts was ever prosecuted was because he was a ‘belligerent ass’ who kept insisting that he get paid back to discharge. He was demanding an appeal in Washington," said the source at the Clement J. Zablocki VA Medical Center in Milwaukee who e-mailed the Lee Rayburn radio show in Madison in early June 2007 about the Roberts affair. "I'd have to say that you guys are TOTALLY (uppercase in the original) right about Roberts' conviction being bullshit ... . "

Jailed Wisconsin Veteran Sent to Solitary Confinement

An innocent and reportedly depressed Navy Airman Keith Roberts (1968-71) suffering from Post Traumatic Stress Disorder (PTSD), and serving a four-year sentence for wire fraud since March 2007, has for reasons unclear been moved and caged in solitary confinement in a federal prison in Minnesota for almost a month, according to the veteran's wife.

Roberts was targeted by the US Dept of Veterans Affairs (VA) in 2003-05, and became the central figure in an Alice-in-Wonderland tale, after U.S. Attorney Stephen Biskupic of Wisconsin and top VA officials schemed to convict Roberts’ of fraudulently receiving VA benefits (by wire transfer as the VA requires).

Despite hostility from high quarters of the VA, Roberts may be again granted the benefits for which he is federal prison for receiving.

U.S. Atty Biskupic is the same U.S. Atty who infamously prosecuted an innocent Wisconsin woman in a political prosecution, and several innocent Wisconsin citizens for voter fraud in apparent service to the needs of the national GOP.

The honorably discharged Roberts, from Gillett, Wisconsin (Oconto county)veteran, has a criminal appeal pending before the Court of Appeals for the Seventh Circuit and simultaneously has an administrative appeal before the U.S. Court of Appeals for Veterans Claims’ (CAVC) on his VA disability case, litigating the same set of facts before two judicial forums.
Roberts and his veteran allies hope for a decision this sometime this year.

Roberts’ U.S. Dept of Veterans Affairs (VA) claim for his diagnosed PTSD (granted and since challenged repeatedly and denied by the VA) is related to, among other stressors, trying to save his friend, Florida native Airman Gary Holland, from being crushed to death by a C-54 airplane while stationed at a naval air base in Naples, Italy in 1969.

The U.S. Dept. of Justice, in the office of US Atty Stephen Biskupic, made the unusual argument of contending (and convincing a jury in federal court) that Holland and Roberts were not friends (an assertion knocked down) and that Roberts was not part of an unsuccessful rescue effort to save Airman Holland, though Roberts was on line duty at the time and the base equivalent of general quarters had sounded as Holland slowly was crushed to death.

Roberts' wife, Delores, sent the following e-mail to this writer over the weekend.
There is nothing at my end of the world to relate to anyone that is good news. Keith has been in solitary for well over a month, no word yet as to why he is there, he can not make telephone calls and when we visited him one month ago he had just been placed there and no word as to why. He is allowed to make one telephone call per month. … He has not heard from the 7th nor from the CAVC. … If you know anyone that would be interested in going to national news on TV or otherwise, that would probably help. Don't know what to do or what to think. (Too) damn depressed, just (to) do the daily functioning, go to work, eat, sleep and occasionally clean house only when needed. Nothing else to report, the rest of the story is too damn depressing to even talk about.
Veteran-advocacy groups deride the delivery of health care and disability benefits to our veterans today as just another example of Bush administration incompetence in administering government services and entitlements to which it is ideologically hostile, a la FEMA and disaster relief.

Roberts had hounded the VA to distraction and when he accused the VA of outright fraud in 2003, one VA Special Agent Raymond Vasil retaliated against this Vietnam-era veteran for seeking retroactive PTSD-related disability benefits—administrative events by Vietnam-era veterans that are politically unpopular with the American Enterprise Institute and the Bush administration.

It is in this context that Roberts was reportedly argumentative and insulting to the VA, accusing the VA of fraud.

“[T]he only reason Airman Roberts was ever prosecuted was because he was a ‘belligerent ass’ who kept insisting that he get paid back to discharge. He was demanding an appeal in Washington,” said the source at the Clement J. Zablocki VA Medical Center in Milwaukee who e-mailed the Lee Rayburn radio show in Madison in early June 2007 about the Roberts affair. “I'd have to say that you guys are TOTALLY (uppercase in the original) right about Roberts' conviction being bullshit ...”

On August 16, 2004, the VA halted the benefits being paid to Roberts based upon Vasil’s investigation; Roberts appealed the decision on September 14, 2004, and was indicted seven months later.

The case has also drawn the attention of Harper's magazine contributor and human rights attorney, Scott Horton:
(T)ake a look at another prosecution brought in Wisconsin against a wounded vet, whose claims for benefits was turned into a criminal prosecution for wire fraud. As Wisconsin Public Radio reports, Keith Roberts, a Navy veteran got into the U.S. attorney’s crosshairs by filing a claim for benefits related to Post Traumatic Stress Disorder (PTSD) diagnosed as occurring because he witnessed and tried to prevent his friend from being crushed to death by a C-54 airplane while stationed at a Naval air base in Naples, Italy 1969, and unrelated assault by the Navy Shore Patrol—granted and then denied, has not yet been decided by the CAVC. But the Department of Veterans Affairs (VA) after being accused of fraud in 2003 by Roberts ignored the CAVC process and investigated and asked that Roberts be prosecuted for fraud by the US Attorney’s office.

The prosecution smacks of retaliation and a plan to suppress veterans claims—Roberts was prosecuted for tenaciously pursuing a claim for benefits, which VA resisted and which is still in the benefits review process. It may be that the veteran is making claims which shouldn't’t be granted, but the decision to resist them by a criminal complaint is very heavy handed. What happens if the Veterans’ Appeals process rules for Roberts? As I read these papers, that seems possible. ...

Veterans' advocates ask that you please contact the following members of Congress expressing your objection that Roberts was:

- Singled out by the VA and prosecuted by the U.S. Attorney because he spoke out against the fraudulent and slow VA

- Was prosecuted for wire fraud while his VA disability benefits claim was and is still being adjudicated in the VA claims process

More Dismantlement of Case Against Jailed Wisconsin Veteran

By Michael Leon

Madison, Wisconsin—An analysis reveals more corroboration of the account of a Vietnam-era airman who witnessed a colleague's death in a gruesome C-54 aircraft accident in 1969 at a Naval Air Facility in Naples, Italy and is now imprisoned for wire fraud.

The crushing death of Airman Gary Holland in the wheel well of the C-54 set in motion a chain of events that 36 years later led the US Veterans Administration (VA) and the US Atty for the Eastern District of Wisconsin in 2006 to indict and convict a veteran, Airman Keith Roberts (1968-71), diagnosed with Post Traumatic Stress Disorder (PTSD), on charges of wire fraud, arguing that Roberts fabricated his role at the death scene and his relationship with Holland, defrauding the VA.

Roberts is currently is serving 48 months in federal prison.

The US v. Keith A. Roberts indictment on mail fraud (April 26, 2005) and later superseded by an indictment on wire fraud alleges in part that Roberts in his “(s)cheme to (d)efraud” the VA “falsely represented material information to the VA” including “that Roberts and airman Gary (Holland) were close friends and roommates.”In fact, an analysis obtained from Roberts wife, Deloris Roberts, of the service histories Gary Holland and Keith Roberts reveals parallel military careers that would make it unlikely that Holland and Roberts were not at least friendly in their relationship, and that contradicts the prosecution’s indictment and trial statements.

Holland and Roberts:

- Took two weeks-long classes together while stationed together in Memphis, Tennessee in 1968
- Were quartered in the same barracks at Lakehurst, NJ where they also trained together for weeks
- Went into the Naval Air Force base in Naples, Italy together as two young airman
- Slept in close quarters (feet away from each other) while at Naval Air Station base in Naples, Italy
- Worked in the same and only base air hangar together
- Took an advancement test together on the morning of the day Holland was killed on Feb. 4, 1969

“I’d say there was a pretty good chance that Keith Roberts and Gary Holland were friends,” said Deloris Roberts. “The prosecution must know this fact.”

Very little exculpatory information was introduced at Roberts’ trial by his court-appointed attorney, and much exculpatory information was not introduced.

After being diagnosed with PTSD and granted disability benefits, Roberts had no idea that political and bureaucratic forces allied with (then) VA Secretary Jim Nicholson in 2004-05 were determined to adopt the policies of the rightwing think tank, the American Enterprise Institute (AEI), ultimately resulting in Roberts’ prosecution after Roberts phoned the VA and complained that the VA were engaging in fraud in processing his PTSD disability claim.

Roberts's phone call and accusation of VA fraud sounded the alarm bells at the VA.Under the Bush administration, the VA is using propaganda to defend a reduction in benefits to veterans with PTSD, and redirect blame towards the troops themselves, often dismissing the PTSD as a mere pre-existing personality disorder, not requiring VA disability benefits, as 100,000s of troops return home form Iraq and Afghanistan damaged and forgotten.

Roberts’ benefits were ultimately cut after his phone call, and US Atty Stephen Biskupic's office used the VA benefits-severed administrative fact as a means of prosecuting Roberts in a criminal process.

Biskupic is the enforcer of a new VA policy adopted from the AEI that veterans suffering from PTSD wallow in a "culture of trauma" and do not deserve "entitlements;" and what Roberts attorney calls "a VA culture of claims denial that has turned into a criminalization of the disability claims process."

Roberts remains a warning to other Vietnam-era veterans suffering from PTSD to not file for PTSD benefits.

Vets Go to Mattresses for Jailed Vet, Rep. Baldwin Hits AG on US Atty Biskupic

- Wisconsin Public Radio Runs Story Listen to this story now using RealPlayer

As Attorney General Alberto Gonzales testified before the House Committee on the Judiciary today, veterans mobilized on behalf of jailed Air Force vet Keith Roberts, indicted and convicted by the controversial US Atty Stephen Biskupic.

In several e-mail trees, the veterans urged veterans and supporters to phone members of the Judiciary Committee questioning Gonzales on the recent firings of US Attys, and what US Attys who had kept their jobs may have done to remain in their positions.

Critics and watchdog groups accuse the Bush administration of the unprecedented politicalization of government, including the Department of Justice and the Veterans Administration (VA), and see the indictment and conviction of Roberts on charges of wire fraud as a consequence of this politicalization.

The vets hit Rep. Tammy Baldwin's (D-Wis) office especially hard, as they perceive her as the only Wisconsin member of the Judiciary Committee known as a champion of veterans’ issues.

Vets' E-mail

The veterans’ e-mail reads in part:

“This is important. I need each of you to act today.... read this

“Urge Rep. Baldwin and your member of the Judiciary Committee to ask AG Gonzales about the Jailed Vet Keith Roberts.

“We want Keith Roberts Freed, and US Atty Stephen Biskupic Fired.

“Attorney General Alberto Gonzales is returning to Capitol Hill on Thursday to testify before the House Judiciary Committee.

“Many Uppity Wisconsin readers know that Airman Keith Roberts (1968-74) is battling political forces allied with VA Sec. Jim Nicholson whose department worked with US Atty Stephen Biskupic, WI, to imprison this Vietnam-ear vet for 48 months on a ludicrous charge of wire fraud, now under appeal.

“Please contact Rep. Tammy Baldwin (D-WI) (now a member of the House Committee on the Judiciary ) http://judiciary.house.gov/CommitteeMembership.aspx
and urge her to seek all documents in this affair and ask Gonzales about Airman Roberts’ indictments.

Vietnam vet calls fraud charges by VA illegal
By Gil Halsted
Thursday, May 10, 2007

(UNDATED) A Vietnam-era veteran from Oconto County is appealing his conviction for wire fraud.

Sixty-year-old Keith Roberts claims the Veterans Administration illegally cut off his benefits. Some veterans’ advocates say the case is part of a broader effort by the Bush Administration to discourage veterans from seeking retroactive benefits for post-traumatic stress disorder.

In 1999, Keith Roberts was diagnosed with PTSD. He convinced the VA that the condition was triggered in 1969, when he saw a fellow airman crushed to death in the wheel well of an airplane at a U.S. base in Italy. Roberts’ wife Delores says several months later, her husband got drunk and got in a fight with military police. She says he was assaulted by the Shore Patrol, put in a straitjacket, put in a psychiatric ward, strapped to the bed and given two injections of thorazine.
The VA initially granted Roberts benefits retroactive to 1992, but he pushed for benefits back to 1972 when he was discharged from the Navy. Timothy Funnel, the U.S. Attorney who prosecuted Roberts for fraud, says that was a mistake. Funnel says trying to get more benefits triggered an investigation that refuted Roberts’ PTSD claims and resulted in his fraud conviction. He says Roberts would in all likelihood be “sitting in Oconto County receiving his monthly compensation benefit check” if he had not because of “his own greed” sought this large retroactive payment.

Roberts is in a Kenosha jail, waiting transfer to a federal prison to serve four years for fraud. He’s also in debt for $300,000 dollars in VA assistance, and $15,000 dollars in tuition benefits his daughter used towards a college degree. Delores Roberts says since her husband’s conviction, the family has been struggling. She says his Social Security benefits were cut off after he’d been in jail for a month, so that meant they had nothing coming in.

Roberts’ lawyer, Robert Walsh, says he’s confident that will change when he wins his appeal, but Walsh says that won’t address the fundamental injustice of prosecuting Roberts for trying to get money he was legally eligible to receive. Walsh says when the U.S. Court of Appeals for Veterans Claims restores VA disability benefits to Mr. Roberts, as he’s confident they will, he asks who will restore Roberts’ reputation and will restore the more than 100 days he has served in confinement illegally. Walsh says that’s a serious concern and should be of concern to the veterans’ community.

Madison writer Michael Leon has taken up Roberts’ cause. After reading more than 2,000 pages of legal documents, Leon says prosecutors illegally ignored the required procedures for VA benefits. Leon says the VA hopes to use Roberts as an example. He says with the agency having so many problems currently, they cannot have numerous Vietnam-era veterans seeking retroactive benefits for PTSD. He says it they did, there would be thousands people “lining up.”

More than 800,000 Vietnam veterans suffer from PTSD and a study released this week shows the VA is spending about four billion dollars a year on PTSD benefits.

Rep. Tammy Baldwin

Coming soon here, Rep. Baldwin’s questioning of Attorney General Gonzales and her reaction to the Keith Roberts affair.

Early reports have Baldwin asking Gonzales about US Atty Biskupic and asking that a New York Times article written by Adam Cohen, "A Woman Wrongly Convicted and a U.S. Attorney Who Kept His Job" be submitted into the record.
One question asked by Baldwin is: “Did USA Biskupic get his name off the firing list by conducting a partisan investigation?" in reference to the discredited Georgia Thompson prosecution thrown out of an appeals court and widely seen as dealing US Atty Biskupic a death blow to his credibility as a non-partisan prosecutor.

US Atty Biskupic and VA Defied US Law to Convict Wisconsin Veteran

Airman Keith Roberts - 1970
by Michael Leon

Madison, Wisconsin—In this Karl Rove/Dick Cheney age of politics when the governmental machinery is so politicized that Richard Nixon seems a progressive reformist by comparison, it’s not surprising to find the United States Department of Justice ravaging a Vietnam-era veteran diagnosed with Post Traumatic Stress Disorder (PTSD).

But many veterans charge the peculiar case of US v. Roberts is a disgraceful miscarriage of justice even by the contemporary swift-boating standards of the Bush administration.

Post Traumatic Stress Disorder (PTSD)

In June of 1999, Airman Keith Roberts (1968-71) was granted a disability rating by the US Veterans Administration (VA) after a 12-year, excruciating benefits claim process to which the honorably discharged American veteran from the northern town of Gillett, Wisconsin was subjected.

Roberts had been diagnosed with (PTSD) years after he witnessed a fellow airman killed in a gruesome C-54 aircraft crushing death of fellow Airman Gary Holland in 1969 while on “line duty” at a Naval Air Facility in Naples, Italy, and later in the same year was assaulted by the Navy Shore Patrol and forcefully hospitalized.

Roberts believed that negligence caused Holland’s death and that the Navy then covered it up, blaming the dead rookie Holland who could not defend himself.

The Vietnam-era veteran had no idea while he was gathering evidence seeking an earlier retroactive date for his successful VA claim, per the advice of a Shawano (Wisconsin) Veteran’s Service Officer, and jumping through hoop after hoop, that not only were his existing VA benefits in jeopardy but his very liberty was in danger.

“The process of gathering evidence to prove PTSD disability is extremely time-consuming,” said Sen. Barrack Obama (D-IL) on August 10, 2005 at a time when the VA was set to review 72,000 PTSD cases, but backed down under intense pressure from veterans and democrats. “It requires the compilation of medical records, military service records, and testimonies from other veterans who can attest to a person’s combat exposure.”

In fact, the VA claims process is not just time-consuming, but can be so frustrating that many vets quit the process, or (especially those suffering from PTSD) are thrown into fits of rage directed at the VA itself.

Anger is a euphemism for how Keith Roberts now feels about the VA.

Since March of this year, Roberts has been serving a 48-month sentence (and his family financially shattered) for alleged wire fraud purportedly committed in his benefits application process with the VA in an outlandish VA-benefits-turned-criminal-charges case now before the U.S. Court of Appeal for the Seventh Circuit (appellate brief due June 29) which Roberts vows to take to the US Supreme Court, if necessary.

Among the main charges against Roberts are that he fabricated his role in trying to rescue Holland and lied about his friendship with Holland, both charges demonstrably untrue.

Frustration with the VA
Anger, panic and frustration with the VA drove Keith Roberts to phone the VA Inspector General’s office at Hines, Illinois in November 2003 at which time Roberts spoke with one Special Agent Raymond Vasil.

Roberts accused the VA of “fraud” as the VA was in the process of determining the date from which his retroactive disability pay was to become effective. Adjustments and frequent remanding (sending back for reconsideration) of cases are common VA practice.

It’s not hyperbole to say that many veterans have died awaiting appeal of their cases.

Vasil (who has no professional law enforcement and VA benefit adjudication experience) disingenuously told Roberts he would look into the fraud accusation against the VA, but Vasil appears to have had no intention of investigating the VA, but rather investigated Roberts who was making waves at the VA amid his angry accusations.

Throughout the VA investigation the Roberts family was subjected to a smirking, mocking demeanor by Vasil, the man whose investigation formed the basis of the later criminal indictment.

Said one hostile veteran advocate, “A cop Vasil is not, just an idiot with a badge.”

VA Federal Law

Veteran-advocacy groups deride the delivery of health care and disability benefits to our veterans today as just another example of Bush administration incompetence in administering government services and entitlements to which it is ideologically hostile, a la FEMA and disaster relief.

The VA, a large department of government growing under the strain of war and non-existent administration planning for the consequences of war, is operating under the authority of specific federal statutes—Code of Federal Regulations (CFR), Title 38, “Pensions, Bonuses and Veterans Relief.”

Title 38 specifically defines and delineates the processing and delivery of VA benefits.

In fact, Title 38 (3.901 Fraud) also specifically defines “fraud” (what Roberts is accused of engaging in) as a false or fraudulent act committed in trying to obtain “any claim for benefits under any of the laws administered by the Department of Veterans Affairs … “

But Keith Roberts was never accused of committing VA fraud, per se.

Roberts’ voluminous C-file, or claims file, well documents Roberts “stressors” that led to his being granted disability benefits—rendering accusing Roberts of VA fraud out of the question, so the offended Special Agent Vasil swiftboated the veteran Roberts.

“Keith Roberts was granted a 100% compensation rate for PTSD from his date of claim. To grant PTSD, we need both a) a current diagnosis and b) a verified in-service stressor. We found not only a stressor, but an in-service diagnosis for Airman Roberts,” said a source at the Clement J. Zablocki VA Medical Center in Milwaukee who e-mailed the Lee Rayburn radio show in Madison after a broadcast of a show on Roberts.

In other words, to an experienced and objective VA civil servant, Roberts’ claim was an air-tight.

But Roberts was to become a cautionary tale for Vietnam-era veterans who apply for PTSD disability benefits and carp about the slow and often hostile nature of the VA bureaucracy after Special Agent Vasil’s investigation of Roberts in an as yet unknown manner came to the attention of the US Department of Justice and US Atty Stephen Biskupic (Eastern District of Wisconsin).

Biskupic, not known for his prosecutorial discretion and hungry to augment his win/loss record, took over the case and secured criminal indictments against Roberts in 2005.

Special Agent Raymond Vasil

After Roberts contacted the VA Inspector General’s office and spoke to Vasil, Vasil reportedly became upset with Roberts making the fraud accusations and seized Roberts’ VA claims file from the VA regional office in Milwaukee, according to a document in Roberts’ VA file dated Dec. 12, 2003.

What appears to have transpired is that Roberts hounded the VA to distraction and when he accused the VA of outright fraud, Vasil retaliated against this Vietnam-era veteran for seeking retroactive PTSD-related disability benefits—occurrences by Vietnam-era veterans that are also politically unpopular with the American Enterprise Institute and the Bush administration.

Zablocki VA Medical Center in Milwaukee who e-mailed the Lee Rayburn radio show in Madison in early June about the Roberts affair.

US Attorney Steven Biskupic
As Roberts’ appeal was being adjudicated in the VA, US Attorney Steven Biskupic stepped in and subsequently secured an indictment on mail fraud on April 26, 2005 under Title 18 United States Code 1341 (mail fraud).

But the indictment on mail fraud involved no investigation from the Postal Inspector’s office, as is usual in mail fraud cases.

“Biskupic really pissed in someone’s pool when he indicted on mail fraud with no investigation from the Postal Inspector,” said a source close to the Roberts’ defense network.

Without explanation from Biskupic’s office, the mail fraud indictment was superseded some four months later in September 2005 when Biskupic secured an indictment on wire fraud under Title 18 USC 1343; this time with no input from the FBI or US Treasury Department, as is usual in wire fraud indictments.

The only law enforcement agency used in the investigation was the VA Inspector General’s office, not a professional law enforcement agency, but an office that operated vindictively in the person of Special Agent Vasil and was run at the executive level by Secretary Jim Nicholson, a former Republican National Committee chairman with no veteran advocacy experience, in an administration taking its cues from the veterans’ benefits-hostile American Enterprise Institute scholar, Dr. Sally Satel.

Title 38 Code of Federal Regulations, Section 3.905 (a) Jurisdiction)

The VA insulates and protects veterans by establishing a layer of procedure before a veteran can be denied VA benefits, much less criminally prosecuted for fraud in seeking benefits.

The Title 38 Code of Federal Regulations, section 3.905 (a) Jurisdiction) statute reads: “At the regional office level … the Regional Counsel is authorized to determine whether the evidence warrants formal consideration as to forfeiture.”

Robert Walsh, the appellate attorney for Roberts and a former VA staff attorney, blasted the criminal prosecution as well as the VA denial of benefits for its lack of review by VA counsel, per Title 38.

"The local VA Inspector General going directly to the U.S. Attorney without any review by VA attorneys appears to be unprecedented and is a violation of (Title) 38 Code of Federal Regulations, section 3.905.

“The U.S. Attorney prosecuting a case such as this without a proper investigation by the F.B.I. or U.S. Treasury is outrageous. It is contrary to the Department of Justice guidelines for such cases. Failure to follow those well-thought out procedures is unwise. So we arrive at this bizarre outcome.

“When Congress passed the Veterans Judicial Review Act which became law in 1988 they created a special court to review disputes over veterans’ benefits, the U.S. Court of Appeals for Veterans Claims (CAVC). No other court was given jurisdiction over these claims, and that court has not yet ruled on the reduction of benefits suffered by Mr. Roberts. If the CAVC rules in favor of Mr. Roberts he will be in prison convicted of fraud for accepting benefits payments that he is fully and legally entitled to."

Biskupic has not spoken publicly on why his office had not awaited the adjudication of the benefits process before seeking indictments for alleged fraudulent statements made by Roberts in his claims, and why Biskupic avoided Veteran Fraud, and indicted on mail fraud and then wire fraud.

Title 38 Code of Federal Regulations, Section 3.905 (b) Fraud

The VA is also required, by federal statute, to notify a veteran if he or she is declared to be fraudulently presenting information to the VA.

The Fraud statute reads:

(b) Fraud or treasonable acts. Forfeiture of benefits under §3.901 or §3.902 will not be declared until the person has been notified by the Regional Counsel … of the right to present a defense. Such notice shall consist of a written statement sent to the person's latest address of record setting forth the following:
(1) The specific charges against the person;
(2) A detailed statement of the evidence supporting the charges, subject to regulatory limitations on disclosure of information;
(3) Citation and discussion of the applicable statute …

Roberts was never notified by the Regional Counsel that he was suspected or accused of engaging in fraud.

Said a source close to the defense network: “The VA statute requires the criminal justice system to stay out of the matter until a FINAL administrative agency decision is in place. That will not happen at the VA until Roberts is done at the Supreme Court. The VA reduction of benefits is under appeal, and will be for some time. So, if they believe in the fraud, why the rush for Biskupic to jump in? Keith is not a killer posing a danger to the public; he is a veteran who simply will not be getting his benefits that he deserves.”

Roberts was caught in a situation where he angered the VA Inspector General’s office which knew that Roberts could never be convicted of VA fraud, so they summarily denied his benefits, and then somehow communicated the case circumstances to US Atty Biskupic who charged Roberts with postal fraud and then with wire fraud using the denial of benefits (under appeal per federal statute) as evidence of criminal fraud.

So before and after Special Agent Vasil was scheming to charge Roberts with fraudulently presenting his VA claim, and Roberts’ liberty became endangered, the VA never notified Roberts through the Regional Counsel or otherwise that his forfeiture was asserted by the VA Inspector General to be based upon fraud.
US Atty Biskupic never addressed the statutory imperative that Roberts should have been so notified by the VA Regional Counsel during the investigation, the indictment and prosecution.

This would appear to raise serious due process considerations that may result in the overturning of Roberts’ conviction by the Seventh Circuit, known for its intellectual heft, though leaning to the right, aside from the fact that Roberts is innocent of not being at the scene of his friend Holland’s death.

Criminal Trial

The criminal proceedings included the misrepresentation of the laws and regulations governing veterans’ disability benefits claims procedures and the military service of Roberts to the jury.

The defense claims that the government withheld hundreds of photographs and documents in their possession from the defense which would have proven that Mr. Roberts did not commit fraud.

Roberts was forced to defend himself in federal court by proving that he was present at his duty station on the flight line in Naples, Italy on February 4, 1969 when Airman Gary Holland was killed while performing maintenance on a C-54 aircraft.

The prosecution produced no witness who testified that Mr. Roberts was not present for duty on that day.

The prosecution produced no witness or document which refuted that the aircraft hanger where Holland was killed was Roberts’ duty station.

Several witnesses testified that general quarters was sounded, as Roberts claimed. The prosecution produced no evidence that Roberts failed to respond to general quarters.

In fact, Roberts received a “Special Enlisted Personnel Performance Evaluation” (the military equivalent of a pat on the back for the then-young airman) two days after the death of airman Holland.

The position of the VA and the US Atty Biskupic is that Mr. Roberts was not present, and therefore his VA disability claim is based on fraud.

“Where were you on February 4, 1969? Can you prove it?” asks Delores Roberts, Roberts’ wife.

Questions for US Atty Biskupic
It is clear that the VA violated its own statuary mandates, but questions remain for the US Atty’s office that prosecuted Roberts.

Did the Secretary of the Veteran's Administration give US Atty Biskupic authorization by delegation of authority to prosecute Keith Roberts before the exhaustion of his administrative remedies under Title 38 CFR?

Did US Atty Biskupic know that the Board of Veteran's Appeals had determined in prior decisions that Roberts' statements could not be used, as a matter of law, to verify a stressor in order to grant service connection for PTSD?

Did US Atty Biskupic know that the VA claim process is supposed to be non-adversarial?

Where in Title 38 does it state that the DOJ can take jurisdiction away from the Veterans' Administration before the VA has completed its review of the veteran's benefits, including the review in the Court of Appeals for Veteran's Claims?

With whom at the DoJ and the VA did Biskupic communicate before arriving at his decision to seek indictments?

Roberts and his family await answers and justice.

Cases to be adjudicated:

· U.S. v. Roberts, U.S. District Court for the Eastern District of Wisconsin, Docket 05-CR-118
· U.S. Court of Appeals for Veterans Claims docket 05-2425
Legal questions and legal comments can be e-mailed to Robert Walsh at: rpwalsh@sbcglobal.net.
Update: A reader's e-mail reads that the District Court stated from the the bench at sentencing that he did not believe that the senseless and negligent death of Naval Airman Gary D. Holland "was a stressor that induced some horrible posttraumatic stress disorder ... "
Right, seeing a friend crushed to death is no big deal.

VA Under Seige as Vietnam-era Vet Fights Bizarre Benefits-Turned-Prison-Sentance Case

by Michael Leon

Madison, Wisconsin—The tragic abandonment and imprisonment of Wisconsin Airman Keith Roberts (Ret., 1968-71) could not have occurred at a graver moment of constitutional peril, when whole agencies of the government have seemingly been usurped by an administration lacking in conscience and public accountability.

"We have never even heard of a case like this, a veteran seeking the benefits to which he was entitled and then, with no regard for federal administrative procedure or for that matter human decency, becoming a victim of extraordinary rendition—a man seeking aid from the VA to a criminal sentenced to four years in federal prison. No veteran, I mean no one, who I have spoken to has even heard of something like this happening," said a veteran close to Keith Roberts' defense network

A government-bludgeoned Wisconsin Air Force veteran currently is fighting legal battles simultaneously against the VA and Department of Justice in two different courts, as he sits in federal prison, with no hope of a commutation from President George W. Bush like Scooter Libby.
In this Karl Rove/Dick Cheney age of politics when the governmental machinery is so politicized that Richard Nixon seems a progressive reformist by comparison, it’s not surprising to find the United States Department of Justice ravaging a Vietnam-era veteran diagnosed with Post Traumatic Stress Disorder (PTSD).

"When Congress passed the Veterans Judicial Review Act which became law in 1988 they created a special court to review disputes over veterans’ benefits, the U.S. Court of Appeals for Veterans Claims (CAVC).
"No other court was given jurisdiction over these claims, and that court has not yet ruled on the reduction of benefits suffered by Mr. Roberts.
"If the CAVC rules in favor of Mr.
Such notice shall consist of a written statement sent to the person's latest address of record setting forth the following:(1) The specific charges against the person;(2) A detailed statement of the evidence supporting the charges, subject to regulatory limitations on disclosure of information;(3) Citation and discussion of the applicable statute …
So, before and after Special Agent Vasil was scheming to charge Roberts with fraudulently presenting his VA claim, and Roberts’ liberty became endangered, the VA never notified Roberts through the Regional Counsel or otherwise that his forfeiture was asserted by the VA Inspector General to be based upon fraud.
US Atty Biskupic never addressed the statutory imperative that Roberts should have been so notified by the VA Regional Counsel during the investigation, the indictment and prosecution.
This would appear to raise serious due process considerations that may result in the overturning of Roberts’ criminal conviction by the Seventh Circuit, known for its intellectual heft, though leaning to the right, aside from the fact that Roberts is innocent of not being at the scene of his friend Holland’s death.
Roberts did not commit fraud.Roberts was forced to defend himself in federal court by proving that he was present at his duty station on the flight line in Naples, Italy on February 4, 1969 when Airman Gary Holland was killed while performing maintenance on a C-54 aircraft.
