Biskupic Leaving in Disgrace

Stephen Biskupic, United States Attorney for the Eastern District of Wisconsin (2002 - present) has announced that he is resigning in January before the new administration takes office.

Good riddance, though Biskupic allowed that he has amassed a good "track record."

Many Wisconsin Democrats and allies would agree with that positive performance assessment.

But I doubt that Biskupic is sending a Christmas card to the proven-innocent Georgia Thompson this year [see also Biskupic tried to 'squeeze' Georgia Thompson, and Investigate Biskupic].

As Biskupic has played the partisan prosecutor for the Republican "voter fraud" myth during his tenure, one wonders how seriously Biskupic reflects on the several overturned voter fraud cases [see also Voter-Fraud Complaints by GOP Drove Dismissals].

Or how about that Vietnam-era veteran, Wisconsin Navy Airman Keith Roberts, [see also U.S. Attorneys Scandal–Milwaukee] who was convicted for receiving VA benefits after the national VA office launched a vendetta against Roberts for being a pain in their bureaucratic butt, as the VA followed the policy advice of the benefits-hostile American Enterprise Institute scholar, Dr. Sally Satel on benefits for Vietnam-era vets who as a group were not always enthusiastic about that particular bullshit war?

Some parting words for Biskupic from the late US Attorney General and Supreme Court Justice Robert H. Jackson:

"Any prosecutor who risks his day-to-day professional name for fair dealing to build up statistics of success has a perverted sense of practical values, as well as defects of character. ... he can have no better asset than to have his profession recognize that his attitude toward those who feel his power has been dispassionate, reasonable and just."

Biskupic fails miserably on that score of being reasonable and just.

Let's hope the next US Atty for the Eastern District amasses a better track record.

And if the US Dept of Justice ever again becomes as politicized and corrupt as it has under the Bush administration, the US Attys should leave the DOJ en masse with their integrity in tact and no judicial victims from corrupt prosecutions.

Jailed Wisc Vet out of Solitary, Elderly Parents Pray for Visit with Son Before Their Death

Today is the innocent and jailed Wisconsin Navy veteran Keith Roberts' birthday.

And Roberts (1968-71) is celebrating it back in the general population in a federal prison in Minnesota, as his wife reports that he has been released from solitary confinement, and is working on a supplemental brief, ordered to be filed with the Court of Appeals for the Seventh Circuit, while Roberts' parents, who are in their 80s and unable to travel to Minnesota, hope to see their son before they die.

Writes Mrs. Roberts in an e-mail:
The prison has put Keith back into Unit D. He is no longer in the 'hole,' they let him out to work on his supplemental brief, now due on May 2, 2008. Not much time left.

Today, April 13th, is Keith's 60th Birthday. Not a real happy one, but things are looking brighter.

Mrs. Roberts also has requested that the following statement be posted (received via e-mail, and edited slightly for clarity):

There is a set of books called American Jurisprudence (Thomson Corporation).

In this set of books under VA Law, it gives the best explanation as to how a Veteran can be entitled to VA benefits. It states that 'there must be evidence in the Veteran's Military Records' that shows proof of the medical condition the Veteran has made a claim for and be entitled to benefits.

VA benefits are not granted based upon what the Veteran says, but upon what his records say.

Keith Roberts was indicted, tried and convicted prior to a final VA decision (in which his benefits were granted and then denied). A decision by a VA Regional Office is not a final decision. (Veterans) can take their appeal all the way to the Supreme Court of the United States of America, this is something that the US Attorney for the Eastern District of Wisconsin (Stephen Biskupic) did not understand or care to understand.

(US Atty) Biskupic was saving his job or attempting to save it. Hopefully the Judiciary Committee of Congress will see that it was only (a) political move and not a real crime that put Keith in prison. No one else in this country has to defend himself or herself before two courts at the same time for the same identical issue.

According to VA law established by Congress once a Veteran, any Veteran, not just Keith Roberts, but any Veteran files his substantive appeal to the BVA (Board of Veterans Appeals) and then to the CAVC (Court of Veterans Appeals) and if need be to even higher courts, a decision is not final until the last appeal is over.

This has not only devastated our children, but Keith's parents are both in the 80's and both are afraid they may never see their son again.

They are unable to travel the long distance to the Federal Prison to visit him, they are both handicapped and live too far away. All of this because the Federal Prosecutors believed the Regional Office of Milwaukee, Wisconsin, stating that Keith Roberts' VA claims appeals were complete.

Jailed Wisconsin Veteran Sent to Solitary Confinement


An innocent and reportedly depressed Navy Airman Keith Roberts (1968-71) suffering from Post Traumatic Stress Disorder (PTSD), and serving a four-year sentence for wire fraud since March 2007, has for reasons unclear been moved and caged in solitary confinement in a federal prison in Minnesota for almost a month, according to the veteran's wife.

Roberts was targeted by the US Dept of Veterans Affairs (VA) in 2003-05, and became the central figure in an Alice-in-Wonderland tale, after U.S. Attorney Stephen Biskupic of Wisconsin and top VA officials schemed to convict Roberts’ of fraudulently receiving VA benefits (by wire transfer as the VA requires).

Despite hostility from high quarters of the VA, Roberts may be again granted the benefits for which he is federal prison for receiving.

U.S. Atty Biskupic is the same U.S. Atty who infamously prosecuted an innocent Wisconsin woman in a political prosecution, and several innocent Wisconsin citizens for voter fraud in apparent service to the needs of the national GOP.

The honorably discharged Roberts, from Gillett, Wisconsin (Oconto county)veteran, has a criminal appeal pending before the Court of Appeals for the Seventh Circuit and simultaneously has an administrative appeal before the U.S. Court of Appeals for Veterans Claims’ (CAVC) on his VA disability case, litigating the same set of facts before two judicial forums.
Roberts and his veteran allies hope for a decision this sometime this year.

Roberts’ U.S. Dept of Veterans Affairs (VA) claim for his diagnosed PTSD (granted and since challenged repeatedly and denied by the VA) is related to, among other stressors, trying to save his friend, Florida native Airman Gary Holland, from being crushed to death by a C-54 airplane while stationed at a naval air base in Naples, Italy in 1969.

The U.S. Dept. of Justice, in the office of US Atty Stephen Biskupic, made the unusual argument of contending (and convincing a jury in federal court) that Holland and Roberts were not friends (an assertion knocked down) and that Roberts was not part of an unsuccessful rescue effort to save Airman Holland, though Roberts was on line duty at the time and the base equivalent of general quarters had sounded as Holland slowly was crushed to death.

Roberts' wife, Delores, sent the following e-mail to this writer over the weekend.
There is nothing at my end of the world to relate to anyone that is good news. Keith has been in solitary for well over a month, no word yet as to why he is there, he can not make telephone calls and when we visited him one month ago he had just been placed there and no word as to why. He is allowed to make one telephone call per month. … He has not heard from the 7th nor from the CAVC. … If you know anyone that would be interested in going to national news on TV or otherwise, that would probably help. Don't know what to do or what to think. (Too) damn depressed, just (to) do the daily functioning, go to work, eat, sleep and occasionally clean house only when needed. Nothing else to report, the rest of the story is too damn depressing to even talk about.
Veteran-advocacy groups deride the delivery of health care and disability benefits to our veterans today as just another example of Bush administration incompetence in administering government services and entitlements to which it is ideologically hostile, a la FEMA and disaster relief.

Roberts had hounded the VA to distraction and when he accused the VA of outright fraud in 2003, one VA Special Agent Raymond Vasil retaliated against this Vietnam-era veteran for seeking retroactive PTSD-related disability benefits—administrative events by Vietnam-era veterans that are politically unpopular with the American Enterprise Institute and the Bush administration.

It is in this context that Roberts was reportedly argumentative and insulting to the VA, accusing the VA of fraud.

“[T]he only reason Airman Roberts was ever prosecuted was because he was a ‘belligerent ass’ who kept insisting that he get paid back to discharge. He was demanding an appeal in Washington,” said the source at the Clement J. Zablocki VA Medical Center in Milwaukee who e-mailed the Lee Rayburn radio show in Madison in early June 2007 about the Roberts affair. “I'd have to say that you guys are TOTALLY (uppercase in the original) right about Roberts' conviction being bullshit ...”

On August 16, 2004, the VA halted the benefits being paid to Roberts based upon Vasil’s investigation; Roberts appealed the decision on September 14, 2004, and was indicted seven months later.

The case has also drawn the attention of Harper's magazine contributor and human rights attorney, Scott Horton:
(T)ake a look at another prosecution brought in Wisconsin against a wounded vet, whose claims for benefits was turned into a criminal prosecution for wire fraud. As Wisconsin Public Radio reports, Keith Roberts, a Navy veteran got into the U.S. attorney’s crosshairs by filing a claim for benefits related to Post Traumatic Stress Disorder (PTSD) diagnosed as occurring because he witnessed and tried to prevent his friend from being crushed to death by a C-54 airplane while stationed at a Naval air base in Naples, Italy 1969, and unrelated assault by the Navy Shore Patrol—granted and then denied, has not yet been decided by the CAVC. But the Department of Veterans Affairs (VA) after being accused of fraud in 2003 by Roberts ignored the CAVC process and investigated and asked that Roberts be prosecuted for fraud by the US Attorney’s office.

The prosecution smacks of retaliation and a plan to suppress veterans claims—Roberts was prosecuted for tenaciously pursuing a claim for benefits, which VA resisted and which is still in the benefits review process. It may be that the veteran is making claims which shouldn't’t be granted, but the decision to resist them by a criminal complaint is very heavy handed. What happens if the Veterans’ Appeals process rules for Roberts? As I read these papers, that seems possible. ...

More Dismantlement of Case Against Jailed Wisconsin Veteran

Madison, Wisconsin—An analysis reveals more corroboration of the account of a Vietnam-era airman who witnessed a colleague's death in a gruesome C-54 aircraft accident in 1969 at a Naval Air Facility in Naples, Italy and is now imprisoned for wire fraud.

The crushing death of Airman Gary Holland in the wheel well of the C-54 set in motion a chain of events that 36 years later led the US Veterans Administration (VA) and the US Atty for the Eastern District of Wisconsin in 2006 to indict and convict a veteran, Airman Keith Roberts (1968-71), diagnosed with Post Traumatic Stress Disorder (PTSD), on charges of wire fraud, arguing that Roberts fabricated his role at the death scene and his relationship with Holland, defrauding the VA.

Roberts is currently is serving 48 months in federal prison.

The US v. Keith A. Roberts indictment on mail fraud (April 26, 2005) and later superseded by an indictment on wire fraud alleges in part that Roberts in his “(s)cheme to (d)efraud” the VA “falsely represented material information to the VA” including “that Roberts and airman Gary (Holland) were close friends and roommates.”In fact, an analysis obtained from Roberts wife, Deloris Roberts, of the service histories Gary Holland and Keith Roberts reveals parallel military careers that would make it unlikely that Holland and Roberts were not at least friendly in their relationship, and that contradicts the prosecution’s indictment and trial statements.

Holland and Roberts:

- Took two weeks-long classes together while stationed together in Memphis, Tennessee in 1968
- Were quartered in the same barracks at Lakehurst, NJ where they also trained together for weeks
- Went into the Naval Air Force base in Naples, Italy together as two young airman
- Slept in close quarters (feet away from each other) while at Naval Air Station base in Naples, Italy
- Worked in the same and only base air hangar together
- Took an advancement test together on the morning of the day Holland was killed on Feb. 4, 1969

“I’d say there was a pretty good chance that Keith Roberts and Gary Holland were friends,” said Deloris Roberts. “The prosecution must know this fact.”

Very little exculpatory information was introduced at Roberts’ trial by his court-appointed attorney, and much exculpatory information was not introduced.

VA Policy

After being diagnosed with PTSD and granted disability benefits, Roberts had no idea that political and bureaucratic forces allied with (then) VA Secretary Jim Nicholson in 2004-05 were determined to adopt the policies of the rightwing think tank, the American Enterprise Institute (AEI), ultimately resulting in Roberts’ prosecution after Roberts phoned the VA and complained that the VA were engaging in fraud in processing his PTSD disability claim.

Roberts's phone call and accusation of VA fraud sounded the alarm bells at the VA.Under the Bush administration, the VA is using propaganda to defend a reduction in benefits to veterans with PTSD, and redirect blame towards the troops themselves, often dismissing the PTSD as a mere pre-existing personality disorder, not requiring VA disability benefits, as 100,000s of troops return home form Iraq and Afghanistan damaged and forgotten.

Roberts’ benefits were ultimately cut after his phone call, and US Atty Stephen Biskupic's office used the VA benefits-severed administrative fact as a means of prosecuting Roberts in a criminal process.

Biskupic is the enforcer of a new VA policy adopted from the AEI that veterans suffering from PTSD wallow in a "culture of trauma" and do not deserve "entitlements;" and what Roberts attorney calls "a VA culture of claims denial that has turned into a criminalization of the disability claims process."

Roberts remains a warning to other Vietnam-era veterans suffering from PTSD to not file for PTSD benefits.

Innocent and Wrongly Convicted Wis. Woman Asks State to Pay $360,000 in Fees, Expenses

AP writer RYAN J. FOLEY has the latest story of the innocent Wisconsin woman whose life U.S. Attorney Stephen Biskupic (of the Eastern District of Wisconsin) tried, in vain, to ruin.

Personally, I think Biskupic ought to pay the innocent Georgia Thompson out of his own pocket, offer a written apology to her and the people of Wisconsin, quit the bar, and vow to Wisconsin citizens that he will not travel within a five-mile radius of any prosecutor's office.

Ever wonder how this guy looks at himself in the mirror every day after what he has done to numerous innocents? Really, how does this guy live with himself? Here's an excerpt from Foley's piece:

MADISON, Wis. - A state employee wrongly imprisoned for corruption asked a state panel Thursday to reimburse her for legal fees and other expenses totaling nearly $360,000.

Georgia Thompson deserves reimbursement from state taxpayers even though federal prosecutors brought the case that wrongly sent her to an Illinois prison for four months, her lawyer told the State Claims Board.

"There is no available relief under federal law for Ms. Thompson," Stephen Hurley said.Thompson, a Department of Administration employee, was convicted last year of steering a travel contract to a company with political ties to Democratic Gov. Jim Doyle.

She was sentenced to 18 months in prison and served four before a federal appeals ruled that she was innocent and ordered her freed.

Democrats in Congress are investigating whether the prosecution by U.S. Attorney Steven Biskupic in Milwaukee was politically motivated and part of a pattern of politicization in the Department of Justice. Biskupic, who was appointed by President Bush, has denied those claims.

Federal Prosecution Cases Undermined by US Attorney Scandal

Richard B. Schmitt in today’s Los Angeles Times notes that the politicalization of the U.S. Department of Justice is being felt in federal courtrooms around the country.

“Defense lawyers in a growing number of cases are raising questions about the motives of government lawyers who have brought charges against their clients. In court papers, they are citing the furor over the U.S. attorney dismissals as evidence that their cases may have been infected by politics.”

That’s a good thing. Now, U.S. Attys are being forced to look over their shoulders.

Wisconsin’s own scandal-plagued US Atty Steven Biskupic (Eastern District of Wisconsin) may even steal a glance at whom he has stepped on—an innocent state worker, innocent voters, and an innocent Vietnam-era veteran.

Jailed Wisc Vet Appellate Brief due June 30th in 7th Circuit

The Vietnam-era airman who witnessed the death of a colleague killed in a gruesome C-54 aircraft accident in 1969 at a Naval Air Facility in Naples, Italy, and was convicted of fabricating his role at the death scene in seeking Veterans Administration disability benefits is appealing his conviction.

Keith Roberts' appeal brief is due June 29 before the US Court of Appeals for the Seventh Circuit. The government brief is due July 30.

Roberts' reply brief is due August 13. Oral arguments are scheduled at the Court's convenience. The case number is: U.S. v. Roberts, E.D. of Wisconsin federal court, docket 05-CR-118. U.S. Court of Appeals for the 7th Circuit, 07-1546.

Despite a mountain of evidence corroborating Roberts’ narrative of events, US Atty Stephen Biskupic’s office was able to convince a jury that Roberts committed wire fraud, using the same federal magistrate to whom wrongly convicted state worker Georgia Thompson's case was assigned.

The appeal will address the US Department of Justice’s disregard for the code of federal regulations covering the Veterans Administration and the alleged violation of Roberts’ constitutional rights.

“What do Extraordinary Rendition, Torture of Prisoners; Abu Gharib; Guantanamo Bay, Georgia Thompson, and U.S. V. Keith Roberts have in common? The answer is George W. Bush, Alberto Gonzales and a total disregard for the rule of law and our Constitution,” said a source close to the defense team.

Said Robert Walsh, the appellate attorney for Roberts, "The local VA Inspector General going directly to the U.S. Attorney without any review by VA attorneys appears to be unprecedented and is a violation of 38 Code of Federal Regulations, section 3.905."

The U.S. Attorney prosecuting a case such as this without a proper investigation by the F.B.I. or U.S. Treasury is outrageous. It is contrary to the Department of Justice guidelines for such cases. Failure to follow those well-thought out procedures is unwise. So we arrive at this bizarre outcome."

Some questions that remain unanswered is why did the US Atty step in prior to the exhausting of the administrative law remedies, when Roberts’ case was still being adjudicated at the VA? What was the rush?

Roberts had accused the VA of fraud in the processing of his claim and a source at the Clement J. Zablocki VA Medical Center in Milwaukee e-mailed a radio show in Madison, saying:

VA Source Blasts Jailed Wisc Vet Case, Alleges VA Retaliation


Madison, Wisconsin—A source at the Clement J. Zablocki VA Medical Center in Milwaukee contacted the Madison-based Lee Rayburn radio show after a broadcast on jailed Vietnam-era veteran, Keith Roberts, and blasted the US Atty’s prosecution of Roberts.

Roberts, of Gillett, Wisconsin, has been serving a 48-month sentence since March.

Roberts was investigated and indicted in 2004-2005 after he repeatedly contacted the regional VA in Milwaukee and VA Inspector General's office in Chicago (after being diagnosed with Post Traumatic Stress Disorder (PTSD)) and accused the VA of fraud, seeking an earlier retroactive date for his disability benefits, per the advice of the late Jim Henning, a Shawano County (Wisconsin) Veteran’s Service Officer.

The VA susbsequently turned the tables on Roberts (though VA personnel misrepresented their investigation to Roberts at the time) and charged Roberts with fraud after Roberts apparently angered some in the government agency with his accusations—accusations not uncommon among veterans (especially Vietnam-era veterans) who have the deck stacked against them in seeking PTSD disability benefits.

“I'd have to say that you guys are TOTALLY right about Roberts' conviction being bullshit,” reads the e-mail in part.

The e-mail’s author’s name is being withheld because of concerns about retaliation against the author and the political sensitivity of the prosecution within the VA.

Roberts’ PTSD was caused, in part, by his witnessing the crushing to death of his fellow Airman Gary Holland by a C-54 aircraft at a U.S. base in Naples, Italy on Feb. 4, 1969.

The e-mail also reads:

I need to say that I cannot speak on behalf of the VA. You can talk about what I tell you in this email, but please don't use my name. I could not locate anyone who wanted to speak for the VA either.

Keith Roberts was NEVER going to get paid back to his date of discharge. That is not the way VA works. You can only get compensation back to the original date of claim for that disability. You can get compensation from date of discharge only if you file a claim within a year of that happening, in which case you would automatically get a free exam.

We are told to never prosecute fraud. If someone is defrauding us, we just deny the claim.

Keith Roberts was granted a 100% compensation rate for PTSD from his date of claim. To grant PTSD, we need both a) a current diagnosis and b) a verified in-service stressor. We found not only a stressor, but an in-service diagnosis for Airman Roberts (emphasis mine).

[Others at the VA] said the only reason Airman Roberts was ever prosecuted was because he was a ‘belligerent ass’ who kept insisting that he get paid back to discharge. He was demanding an appeal in Washington.

The justice department caught wind of him (I don't know about this specifically - it didn't happen here). They launched an investigation and talked to people who were in the hangar, all of whom said Airman Roberts was not present for the incident at hand.

If Airman Roberts had taken his 100% and been happy with it, he would never have ended up like this because we try to give a benefit if at all possible. We do not look for ways to deny - it makes life much easier on us if we just pay the money.

There is actually a picture of him downstairs alerting the cops on duty that he is banned from the building. I'd have to say that you guys are TOTALLY right about Roberts' conviction being bullshit.

Roberts was on line duty at the time of the crushing death and the sounding of the equivalent at the base of a general quarters alarm.

Roberts received a “Special Enlisted Personnel Performance Evaluation” (the military equivalent of a pat on the back for the then-young airman) two days after the death of airman Holland.

Roberts’ narrative and recall of details of events at the crushing death have been confirmed by others present at the scene, including a Naval officer.

More Dismantlement of Case Against Jailed Wisconsin Veteran

Madison, Wisconsin—An analysis reveals more corroboration of the account of a Vietnam-era airman who witnessed a colleague's death in a gruesome C-54 aircraft accident in 1969 at a Naval Air Facility in Naples, Italy and is now imprisoned for wire fraud.

The crushing death of Airman Gary Holland in the wheel well of the C-54 set in motion a chain of events that 36 years later led the US Veterans Administration (VA) and the US Atty for the Eastern District of Wisconsin in 2006 to indict and convict a veteran, Airman Keith Roberts (1968-71), diagnosed with Post Traumatic Stress Disorder (PTSD), on charges of wire fraud, arguing that Roberts fabricated his role at the death scene and his relationship with Holland, defrauding the VA.

Roberts is currently is serving 48 months in federal prison.

The US v. Keith A. Roberts indictment on mail fraud (April 26, 2005) and later superseded by an indictment on wire fraud alleges in part that Roberts in his “(s)cheme to (d)efraud” the VA “falsely represented material information to the VA” including “that Roberts and airman Gary (Holland) were close friends and roommates.”

That's a crazy basis for an indictment.

Putting that aide, in fact, an analysis obtained from Roberts wife, Deloris Roberts, of the service histories of Gary Holland and Keith Roberts reveals parallel military careers that would make it unlikely that Holland and Roberts were not at least friendly in their relationship, and that contradicts the prosecution’s indictment and trial statements.

Holland and Roberts:

- Took two weeks-long classes together while stationed together in Memphis, Tennessee in 1968
- Were quartered in the same barracks at Lakehurst, NJ where they also trained together for weeks
- Went into the Naval Air Force base in Naples, Italy together as two young airman
- Slept in close quarters (feet away from each other) while at Naval Air Station base in Naples, Italy
- Worked in the same and only base air hangar together
- Took an advancement test together on the morning of the day Holland was killed on Feb. 4, 1969

“I’d say there was a pretty good chance that Keith Roberts and Gary Holland were friends,” said Deloris Roberts. “The prosecution must know this fact.”

Very little exculpatory information was introduced at Roberts’ trial by his court-appointed attorney, and much exculpatory information was not introduced.

VA Policy

After being diagnosed with PTSD and granted disability benefits, Roberts had no idea that political and bureaucratic forces allied with VA Secretary Jim Nicholson in 2004-05 were determined to adopt the policies of the rightwing think tank, the American Enterprise Institute (AEI), ultimately resulting in Roberts’ prosecution after Roberts phoned the VA and complained that the VA were engaging in fraud in processing his PTSD disability claim.

Roberts's phone call and accusation of VA fraud sounded the alarm bells at the VA.

Under the Bush administration, the VA is using propaganda to defend a reduction in benefits to veterans with PTSD, and redirect blame towards the troops themselves, often dismissing the PTSD as a mere per-existing personality disorder, not requiring VA disability benefits, as 100,000s of troops return home form Iraq and Afghanistan damaged and forgotten.

Roberts’ benefits were ultimately cut after his phone call, and US Atty Stephen Biskupic's office used the VA benefits-severed administrative fact as a means of prosecuting Roberts in a criminal process.

Biskupic is the enforcer of a new VA policy adopted from the AEI that veterans suffering from PTSD wallow in a "culture of trauma" and do not deserve "entitlements;" and what Roberts attorney calls "a VA culture of claims denial that has turned into a criminalization of the disability claims process."

Roberts remains a warning to other Vietnam-era veterans suffering from PTSD to not file for PTSD benefits.

Update on Innocent Vietnam-era Veteran Jailed

Madison, Wisconsin - Keith Roberts will soon be moved (we don't know when) from a Kenosha, WI jail to a federal facility. We'll get you an address ASAP so he can receive mail (his mail was confiscated as contraband by the good people of the Kenosha county jail).

His appeal is scheduled for May 30th before the 7th Circuit, but will likely be postponed because the trial transcripts were made available to the appellate attorneys only days ago.

Fight Is on to Free Wisconsin Vet



Madison, Wisconsin—As Airman Keith Roberts (1968-74) sits behind bars, serving a four-year sentence for federal wire fraud for seeking disability benefits; the fight to free him has been launched.

The Gillett, Wisconsin native Roberts filed for disability benefits in 1999 after being diagnosed with post-traumatic stress disorder (PTSD) related to an assault by the Navy Shore Patrol in 1969, and the death of a fellow airman killed in a gruesome aircraft accident, also in 1969, at Naples, Italy where Roberts was stationed.

As Roberts was adjudicating his claim in 2005 with the US Veterans Administration (VA), Stephen Biskupic, US Atty for the Eastern District of Wisconsin, in an extraordinary development, stepped in and secured federal indictments and a conviction of Roberts on charges of wire fraud in fraudulently obtaining over $350,000 for the period of 1992 to 2004.

Critics see Roberts as an innocent victim of an unfeeling VA bureaucracy, rightwing forces allied with VA Secretary Nicholson, and an overzealous prosecutor.

Attorney Robert P. Walsh, a gruff Vietnam Vet and former VA staff atty, is assembling a legal team for the appeal of the conviction, and Roberts’ family has set up a legal defense fund.

And an informal group of veterans are offering advice and support to the family and their attorney. Most of the vets’ descriptions of the VA under Secretary Jim Nicholson’s tenure and US Atty Biskupic are profane, and on background.

Defense Fund

“I am tired, I worked the graveyard shift last night and my eyes feel like they have gravel in them,” e-mailed Roberts’ wife Delores.

But the Roberts’ family is tenaciously battling the conviction and has set up a defense fund in Kentucky, administered by Roberts’ sister.

“Over the years I have listened to my brother talk about Gary (Roberts’ fellow airman killed) and that horrible day. Yet neither my mother nor I were ever asked what we recall or what we have seen with Keith,” wrote Roberts’ sister in an internet post. “PTSD is a sensitive matter. … (T)here are those who witness other (atrocities) and it is visible to them on a daily basis for the rest of their lives. Why punish those less fortunate? Is not the fact they were willing to serve and go (where) others could not or would not a reason to offer them assistance when they need it?

Congressman Calls for Resignation of VA Sec. Nicholson

In another development, Congressman Phil Hare (D-IL), a member of the House Committee on Veterans’ Affairs, last week called on Department of Veterans’ Affairs (VA) Secretary Jim Nicholson to resign.

“Our veterans have suffered tremendous setbacks on Secretary Nicholson’s watch,” Hare said. “After presiding over a $1 billion shortfall, a backlog of 600,000 disability cases, staffing shortages at Vet Centers, two security breaches that jeopardized the personal information of our veterans, and now, lavish bonuses to the very VA officials responsible for the whole mess, it is time to say enough is enough.

“ … Time and time again, Secretary Nicholson, a former chair of the Republican National Committee, opted to offer political spin instead of preparing for the inevitable influx of new veterans entering the system,” Hare said. “Veterans deserve a Secretary that will fight for them, not use his or her authority to advance an ideological agenda.”
