Trump's 14th Amendment Nonsense Made Fool of Gov Scott Walker in 2015

Madison, Wisconsin — In 2015 Donald Trump was scoring points with white supremacists voicing his intentions to somehow halt the 14th Amendment citizenship guarantee.

Wisconsin Gov. Scott Walker (R) said, me too, making a fool out of himself in the process, (Mal Contends).

Jenna Johnson of the Washington Post had fun at Walker's expense, reporting the Wisconsin governor's multiple interpretations of the14th Amendment, weeks before Walker ended his campaign for the Republican Party nomination for president amid God's calls for Walker to quit the race.

Reports Johnson:

Walker said Monday that he supports ending birthright citizenship, then said later in the day that the problem could be addressed by enforcing other laws. On Tuesday, a prominent donor confronted Walker on the topic and walked away satisfied that the candidate wouldn't do away with birthright citizenship. On Friday, Walker said he didn't have a position on the issue. Then Sunday, Walker said he does not want to alter the 14th Amendment.

The Wisconsin governor and Republican presidential candidate was asked on ABC's 'This Week' whether he backs Trump's push to end the 14th Amendment's mandate that all children born in the United States are automatically granted citizenship.

'Well, I said the law is there. And we need to enforce the laws, including those that are in the Constitution,' Walker said

Now, Trump is hoping to excite Republican Party racists for the midterm elections by claiming the power to change citizenship law and the 14th Amendment through executive order.

Trump and Walker are racists.

While this Trump stunt may seem a distraction to some, there is a fight to be had as events the last week make abundantly clear.

It's the fight Trump and Walker want. So be it.

ProPublica has obtained audio from inside a child-detention camp in which frightened children are wailing, begging and screaming for their "Mami" and "Papá" over and over again, (Thompson, ProPublica).

The U.S. agents can be heard on the audio mocking the children.

The audio obtained by ProPublica breaks that silence. It was recorded last week inside a U.S. Customs and Border Protection detention facility. The person who made the recording asked not to be identified for fear of retaliation. That person gave the audio to Jennifer Harbury, a well-known civil rights attorney who has lived and worked for four decades in the Rio Grande Valley along the Texas border with Mexico. Harbury provided it to ProPublica. She said the person who recorded it was a client who 'heard the children’s weeping and crying, and was devastated by it.'

This is precisely why Donald Trump's racist chief political advisor drafted the Muslim ban last week—as a means of appealing to white racists and discouraging minority populations from living free from fear.

Nothing sells like fascism to white racists.

When Republicans cheered for Trump to "lock her up" last year, they meant it. Republicans would like to imprison political opponents and minorities who have been and remain a problem in need of a lasting solution by a brave leader.

That this latest act of cowardice is sadism is a fact lost on most Americans ignoring the nature of the Republican enterprise. Inflicting punishment is a tenet of fascism.

Picking on immigrants and refugees is the act of a sadistic bully, since they are the one fairly large group of residents of the United States whose constitutional rights are disputed. The executive order Trump signed late on Friday suspending entrance to the United States for citizens of seven countries and cancelling the US refugee program for four months is probably illegal. The 1965 immigration law forbids discriminating against immigrants on the basis of nationality. ...

The political goal of the order was to whip up anti-Muslim hatred. No immigrant from any of the seven countries Trump named has been guilty of terrorism on US soil in this century. ...

The executive orders signed this past week by Trump appear in the main to have been drafted by alt-Neo-Nazi Steve Bannon, the Rasputin of this administration. ...

In another in a series of coups, Trump on Saturday kicked the director of the Central Intelligence Agency, the Director of National Intelligence and the Chairman of the Joint Chiefs of Staff off of the principals committee of the National Security Council. They will attend only when their expertise is required. He then appointed Bannon to that key body, which advises the president on national security issues. Knowledgeable intelligence and military leaders will therefore often not be in a position to contradict Bannon on the NSC, giving him enormous unchecked and unelected power (NSC staffers also don’t have to be confirmed by the Senate). NSC staffers have been known to ask the CIA to do illegal things like go after Americans on American soil, and I think we may expect a lot of that sort of thing in this administration. Bannon is the CEO of the far right extremist purveyor of fake news, Breitbart, today’s equivalent of the Völkischer Beobachter, the newspaper of the national socialist workers party in 1930s Germany.

The way Bannon crafted the executive order on immigrants that the pliant Trump eagerly signed was guaranteed to be a disaster. It would have been easy enough to say that the provisions would come into effect one month hence. Instead, the Immigration and Naturalization Service was instructed to apply its provisions immediately. This step caused some over 100 passengers to be arrested on arrival and put in holding cells at the airport on Saturday, even though they had a valid visa or green card (permanent residency). Thousands of persons with valid visas or green cards (permanent residency, the last step before citizenship) who happened to be abroad on Friday were effectively locked out of the country. These included nearly 200 Google employees caught abroad on Saturday, whom the company was trying to get back into the country.

One of the first to be arrested, at JFK, was Hameed Khalid Darweesh, an Iraqi who had served as an interpreter for the US army in Iraq. Despite Darweesh’s own patience with it all, that he was one of the first to be arrested gave the Trump-Bannon piece of fascism a further black eye. Darweesh’s vital work put his own life in profound danger and he helped avoid casualties among our troops. For him to be humiliated and handcuffed and reduced to tears spoke volumes about the true nature of the executive order.

Scott Walker Now Refuses to Take "Position" on 14th Amendment Citizenship Clause

Scott Walker heard Donald Trump's reading of the citizenship-birthright clause of the Fourteenth Amendment of the U.S. Constitution and had to get in on this toxic appeal to nativism and bigotry—Walker's political wheelhouse.

"Shortly after Donald Trump released his immigration policy proposal on Monday, Wisconsin Gov. Scott Walker assured reporters that he agreed with Trump's opposition to 'birthright citizenship,'" reported Phillip Bump in the Washington Post. "Absolutely," we should end "birthright citizenship," Walker said to NBC's Kasie Hunt.

How can a candidate for the presidency not take a position on this pillar of American citizenship enshrined in Section One of the Fourteenth Amendment?

Scott Walker can because Walker does not have the slightest conception of common law, constitutional law and judicial policymaking.

Don't look for a detailed position paper outlining Walker's Constitutional analysis: 'It's August-hot in Iowa and I'm tired, enough of Section One of the Fourteenth Amendment.'

Walker did hint at his Constitutional acumen in 2013. In determining the First Amendment's guarantee of freedom of expression does not apply to speech that is critical of Walker, Walker's administration ordered 100s arrested and fined.

U.S. District Court Judge William M. Conley and state courts disagreed with Walker and ordered restoration of the First Amendment at the Wisconsin Capitol, as well as civil recovery of attorneys' fees and other costs. (Mal Contends)

This is why Scott Walker avoids townhall-style listening sessions and unscripted sit-down interviews. He doesn't know anything, ala Sarah Palin. (Mal Contends)

No one expects a presidential candidate to be a Laurence Tribe or a Richard Posner, but being a student of the United States Constitution is critical to serving as POTUS.

This has been a bad month for the candidate of the Koch brothers, the Milwaukee-based Bradley Foundation and the corporate bill mill, the American Legislative Exchange Council (ALEC).

As Walker is forced into discussing public policy, it is becoming readily apparent that Walker is in over his head.

This ignorance is dangerous, as seen when Walker pushed for more secrecy in Walker's aborted scheme to gut Wisconsin's Open Records law.

Walker is a lightweight who takes orders from billionaires and other donors funding his campaign.

Can you imagine Scott Walker as president?

Five weeks-plus into his campaign after his July 13 announcement for the presidency, Scott Walker has earned the distinction of being the candidate who does not, like, know anything, to borrow from Juan Cole.

That mean Stephanie Armour was likely going to ask some public policy question of the erstwhile candidate for the presidency.

Meanwhile, Scott Walker's allies in the Wisconsin legislature want to exempt public integrity and public corruption crimes from Wisconsin's John Doe law that has been on the books since the 19th century (Opoien, Capital Times) (Berghahn, Hurley, Burish and Stanton)

Maybe Walker could ask the teacher to offer a lesson on the Fourteenth Amendment.

Scott Walker, Donald Trump and other Republicans say they want to repeal the birthright citizenship clause of the 14th Amendment as they compete to show racist Republican voters how much they despise immigrants.

"Shortly after Donald Trump released his immigration policy proposal on Monday, Wisconsin Gov. Scott Walker assured reporters that he agreed with Trump's opposition to 'birthright citizenship.' The Huffington Post did a quick count and figured that at least five other 2016 Republican candidates did, too," reports Phillip Bump in the Washington Post.

Elsewhere in the Post, Paul Waldman suggests Republicans with their nativism and crazy talk in immigration may have just handed the White House to the Democratic Party nominee.

Writes Waldman:

[Y]ou can’t say you’re pro-immigrant and advocate ending birthright citizenship. You just can’t.

I promise you that next fall, there are going to be ads like this running all over the country, and especially on Spanish-language media:

'My name is Lisa Hernandez. I was born in California, grew up there. I was valedictorian of my high school class, graduated from Yale, and now I’m in medical school; I’m going to be a pediatrician. But now Scott Walker and the Republicans say that because my mom is undocumented, that I’m not a real American and I shouldn’t be a citizen. I’m living the American Dream, but they want to take it away from me and people like me. Well I’ve got a message for you, Governor Walker. I’m every bit as American as your children. This country isn’t about who your parents were, it’s about everybody having a chance to work hard, achieve, and contribute to our future. It seems like some people forgot that.'
