Halloween Killer Victim's Mother — Wisc Atty Gen Joshua Kaul 'Not There for Me,' 'Doesn't Care,' 'No Help'

Democrat Attorney General Joshua Kaul Should Be Booted from Office

"You want some help to find out what's going on, and he (Joshua Kaul) doesn't help. He don't care about the victims."
 — Mother of victim of Halloween killer

Commentary

Madison, Wisconsin — "People in Fond du Lac and around the state still recall how the little trick-or-treater's brutal death changed forever how they think about Halloween," reads the Fond du Lac Reporter in 2017.

The story is about the nine-year-old murder-molestation victim's Mother and her family's struggle to protect their community and achieve some manner of peace.

The Halloween killer of 1973 lives forever in the Fox River Valley.

I grew up in Fond du Lac, Fondy, and it still gives me pleasure to think of Bob's Pizza, Joe's Fox Hut, many friends and the word, Proust.

But there is another side to Fond du Lac, the Halloween Killer of 1973. Craven politicians like Attorney General Joshua Kaul, who could not care less about victims and their lifelong fight for justice.

As the killer Gerald Turner was almost released, Attorney General Kaul failed the Mother of Lisa French, as reference in a TV spot, while Fond du Lac County District Attorney Eric Toney provided support and effective advocacy.

Kaul is the Democrat creation of Clintonite Democrats who view crime victims and the wrongfully convicted as little people who do not count except as pawns in Democrats' repulsive quest for power.

Now, Kaul is drawing justifiable anger for his despicable blowing off the Mother of the nine-year-old girl killed and molested by Gerald Turner.

The Mother in return is the object of Democrat social media trolls for whom people, whether they be Mothers of crime victims or the wrongfully convicted, do not exist for Wisconsin's Democrat Attorney General and friends.

The trolls brand anyone criticizing Kaul as "unhinged," while neglecting even one word of support for Ms. French.

Democrats are the worst, if it were in my power, I would vote them all out of office.

Wisconsin Democrats Silent on New Steven Avery Filing as Midterm Voting Begins

Democrats blocking innocents' freedom will lose votes — some votes

Update: See new legal filing and updates site.
Updated - Madison, Wisconsin — Republicans attacking Democrats in Wisconsin on crime and law enforcement are nearly as fervent as Democrats' asserting police support.

Midterm absentee voting has begun in Wisconsin, and key Wisconsin Democrats are all in, (trying to be), for police, no matter the misconduct they defend, no matter the innocent lives destroyed in wrongful conviction cases.

The August filing by wrongfully convicted Steven Avery details a new witness who contacted the Manitowoc County sheriff office to report he saw the prosecution's star courtroom witness pushing the murder victim's car onto the property of the defendant. The August filing also details that Manitowoc County Sheriff Dept failed to disclose the witness's phone call, a partial copy of which was obtained by Avery' s post-conviction attorneys, another clear Brady violation.

In this state with a horribly corrupt criminal justice system, the question remains whether Wisconsin voters will reward statewide Democratic Party officeholders who continue to block freedom for the innocent Steven Avery and Brendan Dassey, both of whom the state attorney general and governor know were framed by corrupt law enforcement, amid Brady violations, evidence planting, among other misconduct. highlighted to a worldwide audience in the Emmy-winning Making a Murderer docuseries.

Avery and his nephew, Brendan Dassey, were convicted of first-degree homicide in separate trials in 2007 for the murder of a young photographer, Teresa Halbach. Both men are serving life sentences.

The case is State of Wisconsin v Steven Avery, featured in Making a Murderer in a spectacular examination of police and politcal corruption.

Dassey is seeking a pardon from
Gov. Tony Evers, pointing out the convictions are unreliable. Evers says falsely he cannot pardon Dassey because his Pardon Advisory Board advises him not to pardon Dassey.

Wisconsin Democratic Party officials, Gov. Tony Evers and Attorney General Joshua Kaul, have made the political decision to work for this corrupt law enforcement, even the disgraced district attorney Kenneth R. Kratz who prosecuted both the Avery and Dassey cases. Ken Kratz.

This is political liberalism at its most irrational. Tony Evers and Joshua Kaul will not allow crooked Wisconsin police to take a hit, and both Democrats oppose pardons and agreements to vacate the Dassey-Avery wrongful convictions.

One month into his term in 2019, Attorney General Kaul filed legal responses signaling the DOJ would stall Avery's exoneration by filing procedural objections

Life is cheap to Wisconsin Democrats led by Gov. Evers (D) and Attorney General Kaul (D).

No matter the evidence that has piled up since the airing of Making a Murderer shined a light on police and prosecutorial corruption, Wisconsin Democrats remain committed to keeping in prison those whom they know are innocent.

Democrats love their police, no matter how corrupt, for example, Manitowoc County and Calumet County sheriff operations are, as the midterm elections feature Republican ads showering Wisconsin Democrats as weak on crime.

For Wisconsin Democrats, it's defend police no matter how many innocent lives are destroyed.

Tony Evers rejects Brendan Dassey pardon petition

In December 2019, Tony Evers hid behind his Pardon Advisory Board, a stance the governor has continued through spokesmen in the media and administration who falsely say Evers has no choice but to take the advice of his own advisory board.

But the truth about Evers' pardon power came out two years later, last Spring, when Evers announced he would offer immediate clemency to doctors prosecuted for performing abortions under Wisconsin's nineteenth century antiabortion law. Nothing about Evers' Pardon Advisory Board and its criteria.

Tony Evers, like any Wisconsin governor, has the Constitutional power (executive clemency), to grant pardons, (grants of forgiveness restoring civil rights), sentence commutations (roughly, shortening a sentence), and reprieves, for any reason.

The gubernatorial clemency power is so broad that it is monarchical. Gov. Evers could wake up one morning and decide that only those convicted in courts presided over by judges whom we know are corrupt may be granted royal relief — perfectly within the province of his gubernatorial authority.

Evers set up his Governor's Pardon Advisory Board that advises him on whom to pardon. All clemency decisions remain Evers' and his alone. To be clear, any reporting that also suggests that Evers is bound by his Advisory Board or any other political adviser is erroneous.

Attorney General Joshua Kaul

After the Dobbs v. Jackson Women’s Health Organization last Spring, Joshua Kaul repeated he would not use state resources to enforce the Wisconsin anti-abortion law against convictions of women and doctors.

Going forward

Seth Waxman — a member of Brendan Dassey's legal team — said that when reviewing the outrageous interrogation of Dassey by Mark Wiegert, (current Sheriff of the Calumet County Sheriff's Office), and Tom Fassbender (Wisconsin DoJ, DCI investigator (ret)), that his "blood ran cold."

Gov Evers maintains the explicit state Constitutional authority and right to summarily reject the Board's decision and grant Mr. Dassey his immediate freedom with a stroke of a pen for any or no reason, (Rolling Stone).

This action would entail using capacities that to date Evers has not displayed — intellectual honesty, knowledge of Wisconsin law enforcement, and to the worst of Evers' personal defects, a moral backbone and sensibility to the call of social justice.

Joshua Kaul too could refuse today to oppose Steven Avery's new filing calling for a new trial. A witness, Thomas Sowinski, has come forward and swears in a statement that he saw the prosecution's key trial witness plant the murder victim's RAV4 vehicle on the property of the man, Avery, convicted of homicide in 2007.

In other words, a credible resident swears he caught conspirators red-handed in a frame-up scheme in Wisconsin's infamous murder case drawing headlines in state post-conviction litigation.

Further, Zellner brings another Brady violation to the Court's attention, showing a phone "call to dispatch from a witness claiming to see the vehicle leave the property was not provided to previous counsel. Zellner says her office [recently] received the 'previously suppressed' call that was placed on Nov. 6, 2005. The recording had never been disclosed to the trial defense," reports WBAY-Green Bay, citing another spectacular legal filing on August 16.

A worldwide community remains appalled with Wisconsin "justice." Will Wisconsin voters? November will tell.

Corrupt police worked and worked until planting evidence and character assassination gave a ridiculous local press enough for the get-Avery project in the public mind in east-central Wisconsin. Corrupt Wisconsin courts okayed everything that the prosecution and police did.

Refusal to Prosecute Anti-Abortion Laws Highlights Whim Powering Legal System

Goya, Saturn Devouring His Son,

The image represents America today,
as judicial cult deliberating in secret has
decided women no longer have autonomy

other victims, amid warning, no criticism.
Commentary: Prosecutorial Discretion and Liberty

Madison, Wisconsin — Many citizens read the news that Wisconsin Attorney General Joshua Kaul (D) declared his office will not investigate or prosecute woman for abortion-related 'offenses' with approval.

Kaul made his intentions to refuse enforcement of Wisconsin's 1849 ban on abortion following oral arguments of Dobbs v. Jackson Women’s Health Organization in Dec 2021.

The Supreme Court decision on Dobbs will soon eviscerate reproductive liberty as the judiciary jettisons its station as a Court of law.

"Even if courts were to interpret that [1849] law as being enforceable, as attorney general I would not use the resources of the Wisconsin Department of Justice either to investigate alleged violations of that abortion ban or to prosecute alleged violations of it," Kaul said in an interview with the AP.

Sen. Ted Cruz (R-Texas) claims to be outraged by Kaul and other DAs and attorneys general vowing to refuse to enforce anti-abortion laws.

Republican justices on the nonpartisan Wisconsin Supreme Court will interpret Wisconsin's 1849 ban as enforceable after Republicans on the nonpartisan United States Supreme Court hold women no longer have reproductive liberty.

Kaul was criticized for his abortion-law position by his Republican opponents for attorney general — Fond du Lac County District Attorney Eric Toney and State Rep. Adam Jarchow (R- Balsam Lake) in the AP piece.

"I am proudly pro-life and I will defend the police and defend our Wisconsin laws, including our abortion ban, if allowed," said Fond du Lac County District Attorney Eric Toney (R).

Adam Jarchow said that Kaul is a failed leader for his stated refusal to enforce criminal law. "[W]hile it’s disappointing that he says he will not follow the law, it’s not surprising," said Jarchow.

Some Wisconsin laws are more worthy of being followed and enforced than others.

Fast-forward five months to May 2022 and Jarchow is excoriating his Republican Primary opponent, Eric Toney, for enforcing Wisconsin's emergency order banning mass gatherings in 2020 (Opoien, The Capital Times). Republicans on the Wisconsin Supreme Court decided the ban was illegal.

But there is no rule of law to be found among prosecutors and judges.

Prosecutorial Discretion

Advocates for the wrongfully convicted continue to blast Attorney General Joshua Kaul for his political decision not to employ prosecutorial discretion in the DOJ's ludicrous crusade to keep those whom the State knows to be innocent in prison in post-conviction litigation, (see Steven Avery Motion to Stay Appeal and Remand, includes new eyewitness affidavit. April 12, 2021; Steven Avery Legal Filings - Updates;  State of Wisconsin v. Steven A. Avery, Appeal Number 2017AP002288 Wisconsin Democrats Block Exoneration Seekers.)

Advocates for the exonerated Black Lives Matter protesters in Madison similarly blasted the Democrat-led Dane County District Attorney’s office for changing its charging standard in two bizarre Black Lives Matter cases to accommodate a racist Democrat State Senator, Tim Carpenter (D-Milwaukee).

Prosecuting charged law-breakers is determined by politics, increasingly so.

And the judiciary is a politically charged branch of government that hides behind black robes and pretension.

The rule of law is the product of the personal whims of officeholders. Refusal to acknowledge this reality gives prosecutors (and judges) political cover.

Liberty and the rule of law are little more than political slogans of two corrupt and destructive politcal parties.

And prosecutors, in the words of Robert Jackson, are potentially the worst threats to a civil society.

"While the prosecutor at his best is one of the most beneficent forces in our society, when he acts from malice or other base motives, he is one of the worst," writes Robert Jackson in The Federal Prosecutor.

As prosecutors lie and posture to the public to no accountability, Jackson's warnings speak loudly today.

It's imperative to refuse to enforce unjust law such as bans on abortion animated by a dishonest judiciary engineering its unpopular, anti-liberty agenda in secret, as the U.S. Supreme Court proceeds.

Gap between government and the people

The fact of the matter is the enormous power of the prosecutor to direct state violence has corrupted entire professions, and the judiciary, as these super cults become focused on destroying liberty.

As the liberty of an entire class of people stands on the brink of elimination by black-robed cultists, we should consider the words of Milton Mayer, They Thought They Were Free: The Germans, 1933-45, (University of Chicago Press. ©1955).

"What no one seemed to notice was the ever widening gap ... between the government and the people."

"What happened here was the gradual habituation of the people, little by little, to being governed by surprise; to receiving decisions deliberated in secret; to believing that the situation was so complicated that the government had to act on information which the people could not understand."...

This separation of government from people, this widening of the gap, took place so gradually and so insensibly, each step disguised (perhaps not even intentionally) as a temporary emergency measure or associated with true patriotic allegiance or with real social purposes. And all the crises and reforms (real reforms, too) so occupied the people that they did not see the slow motion underneath, of the whole process of government growing remoter and remoter."

The prosecutor, the judiciary and the legal system as a whole have turned into a remote and destructive force that, even as the system's nature and effect become more obvious, cries out in response that the real danger is public criticism and calls for transparency.

We need massive reform on the power of the prosecutor and the judiciary as institutional narcissism working for totalitarian movements now feeds on the public with renewed appetite.

But even casual observers must know in their hearts, reform is not possible. Only massive civil disobedience and general strikes can save liberty today.

Democrat-led Wisconsin Dept of Justice Is Terrified of Evidence Hearing in Making a Murderer Case

Democrats Block Public Light on Police Misconduct

Madison, Wisconsin — Misstatements, defamation, and refusal to address merits of Steven Avery's legal quest for a second exoneration define Democrat-led Dept of Justice misconduct in post-conviction litigation in State of Wisconsin v. Steven A. Avery, (Appeal Number 2017AP002288).

Unreported in Wisconsin corporate media is the fact the DOJ has gone to unprecedented lengths to block a hearing on law enforcement misconduct that helped frame two innocent Wisconsin men. The State strategy is to delay, defame and make political appeals to corrupt judges and other Wisconsin Democrats who have made the state the worst place to be innocent.

"If Mr. Avery's conviction truly has integrity it will withstand the scrutiny of an evidentiary hearing. Without such scrutiny the question of the integrity and fairness of Mr. Avery's trial hangs like a dark cloud over the Wisconsin criminal justice system," writes Avery attorney, Kathleen Zellner in his Aug 2021 petition to the Wisconsin Supreme Court, (p. 9).

Steven Avery and his nephew, Brendan Dassey, were convicted of first-degree homicide in Wisconsin in 2007 for the murder of a young photographer, Teresa Halbach.

Avery is appealing to the Wisconsin Supreme Court in post-conviction litigation, seeking a new trial or an evidentiary heating in his August 2021 petition.

Since assuming office as attorney general in 2019, Democrat Joshua Kaul has acted perversely in opposition to requested hearings on evidence, garnering disbelief from advocates for the wrongfully convicted and human rights activists.

Kaul is defending the bad work of the odious Ken Kratz, who admits numerous pathologies during his tenure as Calumet County District Attorney to explain away sexual and ethical misconduct in office, before being driven from office, and later resigning his license to practice law in Wisconsin.

Wisconsin attorney Jerome F. Buting has been practicing law here for 40 years. Buting has seen a lot in his practice.

But even Buting was apparently shocked by the conduct of the Democrat Dept of Justice — defying fairness and any sense that a defendant should obtain legal recourse to misconduct — blocking an evidentiary hearing.

Writes Buting on social media after the DOJ penned a bizarre response to Avery's petition before the Wisconsin Supreme Court, a DOJ reponse since publicly rebutted by Avery's attorney, Kathleen Zellner, devastating the DOJ.

It would be difficult for the Wisconsin Judiciary to fall any lower than it has.

The Wisconsin Judiciary has demonstrated that as a branch of government it is no longer an impartial body. Wisconsin courts can be counted on to take the side of corrupt police and dishonest prosecutors no matter how blatant the misconduct in criminal justice litigation.

It is expected in the innocence community that the Democratic-aligned appellate judges — Lisa S. Neubauer and Jeffrey O. Davis — would brush aside state misconduct to politically support Gov. Tony Evers and Attorney General Joshua Kaul, who work against the innocent.

Both Evers and Kaul are running for reelection in 2022, and a scandal implicating Democratic Party elected officials would likely prove disastrous to the Party, so Party functionaries on the bench and other branches are trying to bury Steven Avery.

Moreover, in the Avery case, Kaul's mother, Wisconsin Attorney General Peg Lautenschlager (2003-2007), was deep into covering for Manitowoc County's misconduct after the first wrongful conviction of Avery. Attorney General Kaul is covering for his Mother's old flacking for crooked police.

Wisconsin's evidence preservation law

One illustration of the DOJ and Democratic judges' perfidy concerns the State's returning the murder victim's remains to the Halbach family, a law enforcement scheme revealed when Avery sought to conduct DNA testing, and found out the bones had been destroyed without notice to him, in violation of Wisconsin's evidence preservation law.

Flaunting the evidence preservation law, in 2011 Calumet County Sheriff Deputy Jeremy Hawkins, Mark Wiegert, and DoJ Attorneys Thomas Fallon and Norman Gahn secretly sneaked the remains of Ms. Halbach, and illegally transported the bones to the Halbach family.

The State previously suggested to the Appellate Court in its Dec. 2018 filing that Avery and Zellner drop their appeal without the State ever having "admitted or disclosed that it had given the bones back to the Halbach family in 2011 [illegally] without notice to Mr. Avery or his counsel," notes Zellner in her Feb. 2019 legal filing.

In other words, law enforcement hid evidence it claims is the murder victim, destroyed this evidence, hid the destruction, lied about the destruction, then claimed the evidence cannot be determined to be exculpatory because it has been destroyed.

In short, the State acted in bad faith at every turn.

Even the prosecutor-biased Judge Angela W. Sutkiewicz acknowledges in 2020 what Zellner uncovered: Writes Sutkiewicz: "The report of Deputy [Jeremy] Hawkins indicates that he, Sergeant Investigator Mark Wiegert, Attorney Thoman Fallon and Attorney Norman Gahn removed materials stored in evidence, and released them to the Halbach family," (p 2).

The Appellate Court hearing the case in July 2021, however, divined, "The Halbach family requested these bone fragments for purposes  of  its  own—likely  for  closure ... ."

Yet, even the DOJ's Thoman Fallon and Norman Gahn who implemented the scheme disconfirm this attempt by the Court, contriving a State-Halbach family scheme, to cover for illegal evidence destruction.

Fallon and Gahn argue that the evidence they helped destroy was "inexplicably released" from the Calumet County Sheriff’s Department’s evidence control unit, March 29, 2019 legal filing, (p 13).

Fallon and Gahn, in effect, assert Fallon and Gahn cannot explain why they released and destroyed the evidence, and state nothing about the Court-invented 'family did it' offering by the appellate court.

This 'Halbach family did it' invention appears nothing so much as a public signal to the Halbach family to speak up and get on board with the lie of moment.

"Inexplicably released" is of course a disingenuous characterization for the illegal destruction of evidence that not only implicates Fallon, Gahn and Wiegert, but also is a clear violation of the Due Process Clause, and is a Brady violation under Wisconsin judicial doctrine.

Lost in all the Court and DOJ lies is the fact an innocent man is litigating for his very life.

Wisconsin Attorney General Joshua Kaul: For Cops, by Cops

Kenosha cops beat on the people in 2020
Madison, Wisconsin —  Attorney General Joshua Kaul (D) loves cops so much and he is so tough, he works to keep innocents in prison.

At a time when our country is questioning law enforcement, Wisconsin's Democratic leadership is working against the people, for the police, no questions asked.

Kaul brandished his experience as a prosecutor and delivered his message on the Up Front Sunday political show.

It's the same political playbook used by Kaul's mother, former Wisconsin Attorney General Peg Lautenschlager (2003-2007): Take the power of the state against the people, squash them, and take what you can as a politician.

As for the people who get squashed by the police from Milwaukee to Wauwatosa to Appleton to Manitowoc to Kenosha — they're shit out of luck.

It's like this in Wisconsin: As families work to keep their dreams alive, Kaul is working for the cops to destroy lives.

Politically what happens next to Democratic prosecutors looking to cash in by running tough on people campaigns is unknown.

Working against the people didn't work for Kamala Harris' presidential bid: "Most troubling, Ms. Harris fought tooth and nail to uphold wrongful convictions that had been secured through official misconduct that included evidence tampering, false testimony and the suppression of crucial information by prosecutors," notes Lara Bazelon.

But Kaul is worse than Harris ever was in defending wrongful convictions.

My prediction is the little shit is going to get squashed in 2022.

Making a Murderer — Wisconsin DoJ Plays Games as Wrongfully Convicted Lose Years of Life

Attorney General Joshua Kaul's 'Defend Wrongful Convictions at All Costs' Commitment Is Betrayal of Wisconsin

Madison, Wisconsin — Wisconsin Republicans and Democrats agree on a policy area: Defend wrongful convictions.

Consider the case of Wisconsin v. Steven A. Avery, featured in the Emmy-winning documentary, Making a Murderer.

In post-conviction litigation, the once-exonerated Steven Avery presents game-changing evidence to the Wisconsin state judiciary exposing law enforcement in its second frame-up job against Avery for homicide in 2005.

The second frame-up was committed shortly after Avery prepared evidence for his $36-million civil rights suit for misconduct in the first frame-up (Ferak, Appleton Post-Crescent). Law enforcement officials reasoned if they could pen a homicide case onto Avery, the resultant prosecution would silence the multi-million-dollar civil action.

Brady Violations

In court filings, Avery has chronicled six major Brady violations in post-conviction litigation.

Brady violations are instances when law enforcement disregards its duty to notify a defendant of exculpatory evidence — for the police purpose of securing a conviction, then defending the wrongful conviction.

By effectively blocking exculpatory evidence that law enforcement controls or accumulates, law enforcement becomes the architect of court proceedings to arrive at guilty verdicts and other rulings disfavorable to the defense.

This imposed system that a defendant must navigate is found to violate defendants' civil liberties and Due Process in Brady v. Maryland, (373 U.S. 83 (1963). See also Wisconsin v. Gary Lee Wayerski, from the Supreme Court of Wisconsin, (2015). [Under Wayerski, the Court finds that the prosecution must fulfill its Brady obligation by alerting defense to exculpatory evidence in its possession, even if the evidence is also housed elsewhere.]

In Avery's post-conviction litigation, the Wisconsin Dept of Justice refuses to even respond in legal filings to chronicles of Brady violations and new evidence brought forth, much less accede to a hearing or vacating a corruptly secured conviction, least exposure brings the State to public ridicule.

Instead, the DoJ under direction of Attorney General Joshua Kaul (D) makes motion after motion to delay and block the courts from even considering a request to consider a hearing.

So, while the Brady v. Maryland case acclaiming Due Process is 58-years-old, there is no enforcement guarantee or Constitutional ethics in the Wisconsin judiciary that compels law enforcement to follow the law, so law enforcement flaunts its obligations and judges turn a blind eye.

The Wisconsin Dept of Justice, which argues against Due Process rights in the 2015 Wisconsin v. Gary Lee Wayerski (implementing Brady), today takes the position of, We don't like your Due Process rights, we don't like our Brady obligations, we don't like your bringing up law enforcement law-breaking in your post-conviction litigation.

The anti-Brady ethos lives in Avery's post-conviction litigation as the State of Wisconsin filed a frivolous motion that is demonstrably false and that, further, defames and personally maligns Avery's attorney, Kathleen Zellner (Wisconsin legal filing, April 16, 2021).

In response, attorney Zellner penned a devastating chronicle of State conduct that shows the Wisconsin Dept of Justice to be engaged in serial law-breaking and hostility to its law-breaking being mentioned in Court at the costs of an innocent man's life.

Writes Zellner in Reply to State's Response, April 22, 2021:

It is a supreme irony that in one of the most blatant examples of a wrongful conviction the State's only response is to falsely accuse Mr. Avery's lead counsel of nefarious conduct for discovering a 6th Brady violation. Rather than seeking justice, the State wants to 'slay the messenger' by putting forth more false allegations, a skill that it has mastered over the last 16 years. The State turns a blind eye towards its past actions of withholding exculpatory evidence. When the State disclosed a CD of violent porn from the Dassey-Janda computer 12 years after the CD was created and concealed from prior counsel, the State argued, as it does now, that Mr. Avery was attempting to add new material to his § 974.06 motion. (740.5). When the State facilitated the destruction in 2011 of evidence it had agreed to allow Mr. Avery to test, the State argued, as is it does now, that Mr. Avery was attempting to add new material to his § 974.06 motion. (See 770.2). This Court did not accept those disingenuous responses then, and it should reject the same disingenuous response now. (pp 1-2. Reply to State's Response, April 22, 2021)

The community behind Steven Avery remains optimistic.

But the State's reply to Avery's April 22, 2021 chronicle of State misconduct is to strike the whole reply from the record. More game-playing.

There is a huge body of Constitutional law that makes explicit citizen's rights.

The State of Wisconsin will never heed to this law while a corrupt judiciary keeps rewarding bad faith and ill will of the government towards the citizenry for the purpose of securing injustice.

Attorney General Joshua Kaul, who assumed office in 2019, has conspicuously failed to launch any DoJ investigations into law enforcement, including his own department, despite the widespread criticism of police, Ken Kratz, Tom Fassbender (Wisconsin Division of Criminal Investigation investigator (Ret)) and Mark Wiegert, (current Sheriff of the Calumet County Sheriff's Office), for example, in the Avery case.

Kaul's mother, former Wisconsin Attorney General Peg Lautenschlager (2003-2007) worked to clear law enforcement of misconduct in the first east-central Wisconsin crime pinned on Avery for which he was exonerated in 2003. [Wisconsin Dept of Justice report of the investigation and prosecution of the wrongful conviction of the exonerated Steven Avery; authored by Amy Lehmann, Deb Strauss, Dec 17 2003.]

Point is high Democratic Wisconsin state officials remain opposed to Constitutional rights, and advocate, instead, for law enforcement which has grown into a grave threat to the lives and liberty of Wisconsin citizens.

Watch this space for updates on the Steve Avery post-conviction case.

Like a psychopath with his knee to Avery's neck, the State of Wisconsin works to bleed the life out of an innocent man.

And there is nothing law enforcement can inflict that the Wisconsin Dept of Justice will not defend.

Making a Murderer—Hearing Will Focus on Conduct by Ex-DA, DoJ and Current Attorney General

Attorneys for the wrongfully convicted Steven Avery
will be afforded the opportunity effectively to put
the state of Wisconsin on trial for its conduct, per
the Wisconsin Court of Appeals. Feb. 25, 2019 order.
Innocence workers seek legal relief, likely to be granted or
conceded to at some point, by presenting the factual
record now directly in front of a judicial hearing
that the Dept of Justice worked to prevent.
Misrepresentations discovered in 2019, via a massive FOIA
document dump received in May 2018, are among the legion
of misconduct, deceit and state criminality used to keep
an innocent man in prison (p. 2. March 11, 2019 Supplemental
§ 974.06 Motion for Post-Conviction Relief Pursuant to
State's Violation of Wis. Stat § 968.205
and Youngblood v. Arizona).
Update III: A ruling handed down in August in Manitowoc County Circuit Court is an adverse ruling for Steven Avery, the protagonist and defendant in Wisconsin's Making a Murderer post-conviction litigation.

The ruling was widely expected. Judge Angela W. Sutkiewicz again failed to schedule any proceedings.

Yet, Sutkiewicz divined that the state destruction of evidence accomplished by a conspiracy that includes two of the DoJ attorneys now defending the conviction in post-conviction litigation was done in good faith, and what the state purported to be a murder victim's remains were not scientifically established as a murder victim's remains, hence the state may secretly destroy the evidence it believed are the remains of a murder victim, and the defendant has no recourse.

Absurd.

Writes Sutkiewicz: "The report of Deputy Hawkins indicates that he, Sergeant Investigator Mark Wiegert, Attorney Thoman Fallon and Attorney Norman Gahn removed materials stored in evidence, and released them to the Halbach family."

Corrupt judges like Judge Angela W. Sutkiewicz are a disgrace.

Can you imagine if Fallon and Gahn had to explain themselves as witnesses in open court?

Wisconsin Attorney General Joshua Kaul continues to allow two DoJ attorneys who disregarded Wisconsin Evidence Preservation statute to work this post-conviction litigation, though their conduct is suspect and worth of a criminal investigation.

Update II: The Feb 25, 2019 appellate court order mandating "any proceedings necessary to address [Avery's] claims" points to a hearing after briefing at the circuit court to which the case has been sent back.

The Manitowoc circuit court has not set a timeline, a calendar, hence references here to the contemplated hearing use "to-be-scheduled."

The headline should be be changed to reflect the 'as-yet-ordered' status to clarify the hearing has not been scheduled (as noted) meaning not yet ordered.

The appellate court notes the case's "extensive history," that in this case means voluminous law enforcement misconduct that cannot be reasonably adjudicated at circuit court without a hearing, consistent with the appellate court's order of "necessary proceedings" to produce the appellate court's stated desired "ruling," (p. 3).

Updated - Madison, Wisconsin—The Wisconsin criminal justice system is working against an innocent man.

Not an unusual state of affairs in Wisconsin, but this case—featured in the Emmy-winning Netflix documentary Making a Murderer—promises to reveal a spectacular law enforcement scandal in a to-be-scheduled May hearing in Manitowoc County that the Wisconsin Department of Justice (DoJ) worked to prevent. [See Appeal Number 2017AP002288 for case history.]

Steven Avery, the twice-wrongfully convicted man, faces multiple Wisconsin law enforcement personnel engaging in misconduct.

Yet no members of Wisconsin law enforcement have stepped forward as whistle-blowers, out of a sense of decency, to simply state, framing Steven Avery is wrong.

Disgraced ex-District Attorney Ken Kratz

Avery's quest for exoneration is a legal war against the work of Ken Kratz, the disgraced ex-district attorney who is a sex offender (sexual harassment, and outright assault allegations), who can no longer practice law in Wisconsin because of a suspended license.

Former Calumet County District Attorney,
Ken Kratz, helped frame, and prosecuted
the wrongfully convicted Steven Avery, say
Avery's advocates. Kratz' law license
is suspended in Wisconsin.
Kratz' legal and personal reputations have taken such a beating that he is attempting to sell the Internet domain name of his private law office, Kratzlawfirm.

Kratz Law Firm, LLC [Entity ID K040945] dissolved in February 2012, according to records at the Wisconsin Dept of Financial Institutions (DFI).

As late as 2015, Kratz claimed to be doing business in private practice in Superior, Wisconsin, at Kratz Law Firm (Mal Contends).

A search of Wisconsin DFI records reveal no business entities registered to Kratz during 2015, or after Feb 2012.

This raises the question, why was Kratz claiming to do business as Kratz Law Firm, LLC, when state records reveal that no such business entity existed after February 2012?

Attorney General Josh Kaul

No matter.

Attorney General Josh Kaul (D) has taken up defending Kratz' bad-faith prosecution.

Under the administration of Attorney General Joshua
Kaul (D), the Wisconsin Department of Justice (DoJ) refused
to address the merits of Steven Avery's characterization
of Wisconsin's post-conviction misconduct
— DoJ bad faith, evidence destruction and suppression
— because the DoJ cannot credibly do so.
In under three months since assuming office, Kaul has presided over both committing and defending acts of evidence concealment and destruction, while misleading Avery's attorneys and state appellate justices (p. 2. March 11, 2019 Supplemental § 974.06 Motion for Post-Conviction Relief Pursuant to State's Violation of Wis. Stat § 968.205 and Youngblood v. Arizona).

Kaul proved anew Wisconsin Democrats are as complicit as Republicans in defending wrongful convictions, deflating hopes the Wisconsin police-prosecutor state is under serious challenge by reformists after the 2018 elections.

Notes Avery's attorney, Kathleen Zellner, in her Feb. 1 legal filing.
The [State] ... conveys an attitude of impunity for its past actions of withholding exculpatory evidence and its current action of continuing the concealment of its destruction of potentially exculpatory or useful evidence. ...

The State wants this Court to overlook the undisputed fact that 2 weeks ago, on December 28, 2018, when it filed its response to Mr. Avery's request for new DNA testing of the bones from the Manitowoc Gravel Pit, it never once admitted or disclosed that it had given the bones back to the Halbach family in 2011 without notice to Mr. Avery or his counsel. (Plaintiff-Respondent's Response in Opposition to the Petition to Stay the Appeal and Remand this Case to the circuit court, December 28, 2018, pp. 1-8). Instead, the State carried on its charade of concealment by claiming that Mr. Avery could voluntarily dismiss his pending appeal (pp. 1,2) (emphasis added).
The Court of Appeals agreed with Zellner.

Reads the Feb. 25 Court ruling in part:
The State’s objection does not address the merits of Avery’s claimed statutory and constitutional violations, and it has not responded to Avery’s supplemental filings alleging the possible destruction of evidentiary items which, it appears, the parties previously agreed to preserve.

The State suggests that the appeal is languishing and that if Avery wishes to pursue new claims outside the scope of the WIS. STAT. § 974.06 post-conviction orders presently on appeal, he could dismiss the pending appeal, or wait until its conclusion to file his new claims. As to the former, Avery understandably disagrees, aware that dismissing this appeal will preclude review of the underlying orders entered to date (emphasis added).
The State previously suggested to the Court in its Dec. 28, 2018 filing that Avery and Zellner drop their appeal without the state ever having "admitted or disclosed that it had given the bones back to the Halbach family in 2011 without notice to Mr. Avery or his counsel," notes Kathleen Zellner her Feb. 1 Reply filing.

The DoJ can be counted on to do its worst in this post-conviction litigation.

Wisconsin v. Steven Avery
(2017AP002288)

The DoJ improbably cleared Manitowoc County law enforcement, including District Attorney Denis Vogel, for the first wrongful prosecution of Avery (Amy Lehmann, Deb Strauss, Peg Lautenschlager. DoJ Avery Review. Dec 17 2003).

The DoJ's Division of Criminal Investigation's (DCI) Deb Strauss, co-author the 2003 review that cleared Manitowoc County en masse, was so eager to pin another violent crime on Avery, that when murder victim Teresa Halbach went missing, Strauss contacted Calumet County offering to investigate Avery.

What was Strauss doing?

Now, the DoJ under Attorney General Kaul's administration is engaging in its own misconduct in obstruction (Rolling Stone).

One wonders if Kaul will order a review of the second investigation and prosecution of Avery after the conclusion of Avery's post-conviction litigation.

Further subjects of a DoJ review should include the DoJ's own attorneys and the facts and circumstances of their conduct in the post-conviction litigation.

For Wisconsin law enforcement and adjudication of criminal justice, we are a nation of men and women, laws and ethics are optional.

In opposing post-conviction litigation by concealing evidence against Avery, (Making a Murderer), Wisconsin Attorney Josh Kaul (D) is offering polemics, pointless antagonism and the defense of apparent criminality and willful violation of constitutional rights and state law committed by Wisconsin law enforcement.

Kaul is delaying the inevitable, defending a miscarriage of justice and doing dishonor to Wisconsin.

I have lived in Wisconsin all my life, and I do not see the bottom, though Josh Kaul is dredging the filth of Wisconsin as he blocks, obscures and delays, motivated from a pathology only Kaul can truly explain.

Wisconsin Attorney General Joshua Kaul Is Promoting a 'Mockery of Justice' in Making a Murderer Case

Above, attorney Kathleen Zellner is shown walking with
innocent people for whom she and her legal team have won
exoneration and freedom. The world-renown attorney
faces perhaps her biggest challenge yet against corrupt
Wisconsin law enforcement, and a state judiciary hostile
to civil rights and stacked with corrupt jurists biased in favor
of police. Zellner has won a worldwide following of
admirers
who object to the imprisonment of people known
to be innocent.

Innocent awaits ruling from corrupt county circuit court

Madison, Wisconsin — A wrongfully convicted man, Steven Avery, is awaiting a state circuit court ruling on his motion for an evidentiary hearing, and a new trial.

The Feb 25, 2019 appellate court order mandating "any proceedings necessary to address [Avery's] claims" points to a hearing after briefing at the circuit court to which the case had been sent back.

No such proceedings have been ordered to this date.
 ---
Steven Avery's story is abject demonstration of the determination of law enforcement to work against innocents, and the incapacity of Wisconsin society — corporate media, police, courts, bureaucracies, elected representatives and many citizens — to even acknowledge the perverse efforts of the Wisconsin Dept of Justice (DoJ) now led by Attorney General Joshua Kaul (D), to keep innocents in prison.

Kaul is working to shield criminal acts committed by Wisconsin law enforcement by blocking examination of evidence, opposing all court hearings, and promoting "finality in criminal litigation" so that police and prosecutorial misconduct are protected, and the innocent remain imprisoned, (p.4. State's Response to Defendant's Motion for New Trial Based on Alleged Youngblood Violation, March 29, 2019).

Steven Avery is featured in the Emmy-winning documentary, Making a Murderer.

Kaul has the discretion to accede to Avery's requests for transparency and open examination of evidence and state misconduct.

The case is now before Sheboygan County Judge Angela W. Sutkiewicz who is expected to issue a ruling within weeks on Avery's legal motions.

Sutkiewicz is a corrupt judge who does the work of police and prosecutors against people and the cause of truth.

Advocates for truth in the Avery case expect their efforts to be won in state appellate court after an anticipated adverse ruling by Sutkiewicz.

The post-conviction ligation is State v. Steven A. Avery, Appeal Number 2017AP002288, now before Manitowoc County Circuit Court, substituted by Sutkiewicz.

State of Wisconsin Criminality

In its late-March legal filing, the DoJ argues only procedural objections to Avery's charges of bad-faith state evidence destruction, deceit, concealment and deception, all of which present Due Process questions, (Steven Avery legal filings; #Work with KZ, WBAY, WLUK).

Continuing its strategy of avoiding mention of charged state criminality and lawlessness in litigation, the State's conduct is striking in its avoidance of the merits of Avery's charges that the Calumet County Sheriff's Office secretly transferred evidence, the remains of a murder victim, Teresa Halbach, to private custody in 2011, in violation of state statutes that govern preservation of physical evidence collected; among other allegations.

Commenting on the State's March 29, 2019 legal filing in Newsweek Magazine, Avery's post-conviction attorney, Kathleen Zellner, said:

Wisconsin Dept of Justice is painting itself into a corner
in its effort to keep innocent men in prison. "The State
is thumbing its nose at the appellate court once again,"
wrongful conviction attorney Kathleen Zellner told Newsweek
on April 2. "That court specifically ordered that the merits of the
alleged bone destruction be addressed. Rather than follow the
court's directive, the State has constructed a convoluted
procedural argument that defies logic or precedent."
'Of course the State cannot address the merits of Avery's claim, because it is blatantly guilty of evidence destruction. Its charade continues without the slightest inclination to discover the truth. Significantly, one of the culprits in the whole sad scenario authored the State's Response. Unfortunately, the citizens of Wisconsin are the recipients of this mockery of justice.'

Zellner refers to the DoJ post-conviction litigation team and Thomas Fallon, who helped oversee the decision to return the alleged human bones to the Halbach family. Fallon wrote the state’s response, and is defending his own misconduct.

The post-conviction ligation is State v. Steven A. Avery, (Appeal Number 2017AP002288), now before Manitowoc County Circuit Court.

Before Zellner won her motion for a remand (sending back) the case to Circuit Court, Zellner and other advocates for the innocent Avery argued in her Feb. 1 legal filing:

Making a Murderer — Appellate Court Gives Avery a Defeat

In Steven Avery's quest for a second exoneration of an apparent
frame-up scheme by Wisconsin law enforcement, the State worked
successfully to block a hearing on its misconduct and numerous
Brady violations.

Paths remain for Avery to pursue Post-conviction litigation

Updated - Madison, Wisconsin — Steven Avery's quest for a second exoneration moved backward today as the Wisconsin Court of Appeals (CoA), Dist Two ruled against his request for a lower court hearing.

The case is State of Wisconsin v Steven Avery, featured in the Emmy-winning Making a Murderer docuseries.

The ruling by a unanimous three-judge panel is a Court statement that the Wisconsin judiciary and Wisconsin Dept of Justice share a commitment to blocking paths to exoneration for clearly innocent people convicted, and behind bars.

With this ruling, Wisconsin joins the worst of states nationwide who work to keep innocent people imprisoned.

The ruling follows a spectacular development last April that saw witness Thomas Sowinski of Manitowoc swear in a statement that he saw the prosecution's key trial witness plant the murder victim's RAV4 vehicle on the property of the man convicted of homicide in 2007.

Wisconsin Democratic Party officials, Gov. Tony Evers and Attorney General Joshua Kaul, have made the political decision to work for law enforcement, including the disgraced ex-district attorney, Ken Kratz, against the wrongfully convicted.

So, it was expected in the innocence community that the Democratic-aligned appellate judges
— Lisa S. Neubauer and Jeffrey O. Davis — would brush aside state misconduct and new evidence to politically support Gov. Tony Evers and Attorney General Joshua Kaul, who work against the innocent.

Both Evers and Kaul are running for reelection in 2022, and a scandal implicating Democratic Party elected officials would likely prove disastrous to the Party.

In order for the Court to reach its conclusion today, Democratic partisan judges who joined with Judge Paul F. Reilly had to overlook official misconduct, including evidence tampering, false testimony, multiple Brady violations and other suppression of critical information by all manner of law enforcement, including the state Dept of Justice.

The decision was met with wounded howls and derision by those who fight for the wrongfully convicted around the world.

But Avery's attorney, Kathleen Zellner, noted that there are paths still open for a clearly innocent man, even against a corrupt Democratic Party and Wisconsin judiciary.

Said Zellner in a social media post this morning, "Not deterred by the appellate court decision—-it pointed out the specific doors that are still open for Mr. Avery’s quest for freedom. We appreciate the careful review."

Still, the unmistakable message of the Wisconsin judiciary to the wrongfully convicted seems clear: Abandon all hope, ye who enter here.

In the face of the Dept of Justice working to block a hearing on new evidence, the Court decided that "Simply put, Avery’s appeal cannot continue indefinitely," in effect rewarding the DOJ for its stalling tactics, and denying Avery a hearing to argue against prosecutorial misconduct.

Today's ruling can be appealed to the Supreme Court of Wisconsin; another motion can made at the County Circuit Court level, in accordance with today's opinion.

But readers should make no mistake, the State of Wisconsin and the Democratic Party have worked to arrest, convict and keep imprisoned a man whom they know to be innocent.
