Left Unexplained: How 2,177 Signatures on Green Party Nomination Disappeared
Madison, Wisconsin — Voter obstruction, dark money, corruption in public office; Democrats are adopting the ways of the Republican Party.
The Wisconsin Supreme Court delivered another political decision yesterday that attacks a foundational right of citizens to organize and place a candidate of their choosing on the ballot for voters' consideration.
The Wisconsin Supreme Court issued an instantly infamous 4-3 decision that denied the Green Party petition challenging the Wisconsin Elections Commission staff decision that was imbued with the force of law, in error, by a Commission administrator.
The Green Party and its Wisconsin citizen supporters wanted the Green Party's presidential and vice-presidential candidates to appear on the General Election ballot.
In Dane County, Democratic Party-aligned municipal and county election officials issued several communications on social media specifically implying a preference in the Howie Hawkins - Green Party petition (litigation) before the Supreme Court of Wisconsin.
For example, some 25 minutes before the Supreme Court released its decision, the Madison City Clerk signaled its office's desire to mail out the specific ballots for which the Democratic Party fought — without the Green Party's presidential and vice-presidential nominees.

This and other local officials' communications make clear the Democratic Party-aligned election officials' preference on ballots, though Hawkins was being adjudicated after a Green Party petition to the Court. [See The Rachel Maddow Show, for example, for reporting on election clerks' stated preference on which ballot they mail out: With Green Party or without Green Party. Maddow's piece calls the Green Party and Wisconsin citizen efforts to place a candidate on the ballot a "scam," a position that is the consensus among Democratic Party allies (see Court foils Republican Green Party scam to sap Democratic votes).]
Election officials had no business expressing a ballot preference. This calls into question their neutrality in administering elections without bias when these same officials' political survival is contingent on the Party, the Democratic Party, that instigated dubious administrative action against the Democrats' political opponent.
Local officials should not express or even appear to imply desired outcomes of litigation that involve any private political party whose material benefit is dependent on the Court opinion and order.
Put another way, local election officials should have zipped it and let the litigation proceed without public, social-media comment.
But fealty to the Democratic Party outweighs the needs for unbiased administrations of elections, so social media communications rife with political positions were emitted, and traditional watchdogs were silent.
One dissent written by Chief Justice Patience Drake Roggensack lays out why the Commission is in error and the concern that the liberty interests of Wisconsin citizens and voters should be taken into consideration in administrative and Court deliberation.
In normal functioning of the Commission, a complaint against a nomination is evaluated, an advisory memo is prepared by staff, and the commissioners vote.
Well, the commissioners voted on the complaint and it did not pass. No matter, the complaint was accepted with the force of law.
¶19 It is important for the public to know that there are election laws that bear on [Allen] Arntsen's challenge, which the Commission refused to follow. First, the Commission was required to presume that the addresses listed on the nomination papers were the correct addresses for the dates listed because Wis. Admin. Code § EL 2.05(4) requires that "[a]ny information which appears on a nomination paper is entitled to a presumption of validity."Section EL 2.07(1) confirms that the Commission "shall apply the standards in § EL 2.05 to determine the sufficiency of nomination papers."Second, § EL 2.07(3)(a) requires that "[t]he burden is on the challenger to establish any insufficiency."
¶20 Here, Arntsen's challenge was based on "information and belief."He had no personal knowledge of where Walker lived on what date; therefore his allegation is insufficient to overturn the presumption that the addresses listed on the nomination papers are correct. Since Crane v. Wiley, 14 Wis. 658 (1861), we have held that allegations based upon information and belief in a complaint make a verification insufficient for material facts. However, the Commission's votes showed it did not honor the presumption of the nomination papers' facts as Wis. Admin. Code §EL 2.05(4) requires; it did not require Arntsen to prove that the addresses on the nomination papers were incorrect as §EL 2.07(3)(a) requires; and it treated Arntsen's allegations made on information and belief as if they proved that Walker's address was incorrect on more than 1,800 nomination papers.
¶21Mérida appeared on behalf of the Green Party candidates at the August 20, 2020 Commission meeting to present evidence about the dates that Walker lived at each address, as legal counsel for the Commission told her she could do.2However, Ann Jacobs, who served as chair of the Commission, prevented the presentation of evidence about the dates of Walker's move. The Commission then voted 6-0 to sustain Arntsen's challenge to 57 signatures and rejected it for 48 signatures. The Commission also voted on whether to sustain Arntsen's challenge to 1,834 signatures on nomination papers that contained Walker's earlier address. The Commission deadlocked, with 3 Democratic appointees voting to sustain Arntsen's challenge and 3 Republican appointees voting to deny it. Therefore, Arntsen failed to meet his burden to prove 2The meeting can be viewed in its entirety at https://wiseye.org/2020/08/20/wisconsin-elections-commission-special-teleconferencemeeting-10/. any insufficiency of the addresses for Walker listed on the nomination papers. Wis. Admin. Code § EL 2.07(3)(a). At that point, the Green Party candidates had 3,909 presumptively valid signatures pursuant to §EL 2.05(4) (3,966 filed less 57 signatures rejected by the Commission).
¶22However, notwithstanding the Commission's vote on August 20, 2020, on August 21, 2020, the Commission Administrator sent Hawkins and Walker a letter stating that since the Commission had certified a total of only 1,789 signatures, less than the 2,000 required for ballot access, Hawkins' and Walker's names would not be on the ballot for the November 3, 2020 general election. There is no explanation in that communication about how the Commission disallowed an additional 2,177 signatures that were presumptively valid after the Commission voted to invalidate only 57 of the 3,966 signatures submitted. The Commission Administrator must have treated Arntsen's challenge to 1,834 signatures as having been proved, even though the Commission had voted not to sustain his challenge.
¶23 On August 26, 2020, the Commission certified the independent candidates for President and Vice President. On September 1, 2020, the Commission certified the party candidates for President and Vice President to the county clerks. The September 1, 2020 communication notified the county clerks of the legal challenge to ballot access that had been filed by Kanye West and Michelle Tidball and that there were media statements from the Green Party candidates that they intended to file a court action to gain ballot access. Therefore, at least by September 1, 2020, the county clerks knew that the Commission's certification may not be the final ballot for the November 3, 2020 general election.
¶24 The Green Party filed suit seeking ballot access on September 3, 2020. Perhaps, the Green Party could have filed suit on August 26, 2020, when the Commission certified the independent candidates. However, lawsuits take time to gather relevant documents and affidavits needed to proceed . In addition, the county clerks were on notice from September 1, 2020, when the Commission certified the final ballot for the November 3, 2020 election, that the Green Party would likely file suit and that Kanye West already had filed suit for ballot access.
¶25 This lawsuit is not about the Green Party sleeping on its rights. It is about the treatment that independent candidates from a small political party received from the Commission, who repeatedly refused to follow the law relative to nomination papers.
¶26 It has been said that transparency is the best medicine for curbing governmental practices that abuse the rights of those who must interact with government. The Commission ignored its legal obligations under Wis. Admin. Code §§EL 2.05(4) and EL 2.07(3)(a), and in so doing it suppressed the rights of voters to choose Green Party candidates for President and Vice President. The court's Order is silent on the Commission's unlawful conduct and imposes no consequences for what it has done. The court's silence not only affirms lawless conduct by the Commission, but also provides no directive for the required treatment of nomination papers in the future.
¶27Silently affirming lawless conduct that has been brought to the court's attention is an abdication of the court's obligation to stand with the law, even when doing so is uncomfortable. Accordingly, I respectfully dissent from the Order and join the opinion of Justice Annette Kingsland Ziegler that follows. #

Greens Denounce Wisconsin Supreme Court Decision
(Syracuse, NY – September 14, 2020) Green Party nominees for President and Vice President, Howie Hawkins and Angela Walker, rejected the decision handed down earlier today by the Wisconsin Supreme Court, to deny placing them on the November 2020 ballot. The Green Party has been on the ballot in Wisconsin for every presidential election since 1996.
Several years ago, the workers of Wisconsin occupied the state capitol building with shouts of “this is what democracy looks like.” Angela Walker mobilized her Milwaukee transit workers local union into that defense of workers’ rights. Unfortunately, today, the state Supreme Court demonstrated something completely different from what most people consider to be democracy: a choice on their ballot.
“The court majority failed to recognize the partisan Wisconsin Election Commission’s repeated unlawful actions, said Andrea Mérida, campaign manager.” Mérida continued, “now we have a dangerous precedent where a major party can effectively decide which minor parties can participate in elections, by conjuring up arbitrary requirements on the fly to remove its opposition. Regardless, the fact remains that we met all of the legal requirements for ballot access and followed the WEC’s instructions to the letter with regards to Angela Walker’s change of residence.”
“We were screwed. As the dissenting opinion explains, the actual facts and the law show that we are qualified for the ballot. Partisan hacks should not be running elections for their own parties. They set up the absentee ballot snafu. The decision is a travesty of justice,” said Hawkins.
“Our campaign rejects the idea that we should be punished for what the court majority considers an untimely legal response. As noted in the dissenting opinion, our campaign filed only two days after the Commission certified their list of independent candidates. As a working-class campaign that cannot afford attorneys on retainer, unlike the two major parties, it takes time for us to find legal representation, formulate a response and file documents,” Angela Walker said.
The campaign is currently weighing its legal options, and Wisconsinites may now have to write-in Howie Hawkins and Angela Walker in order to vote for the only presidential ticket that fights for a Green New Deal, Medicare for All, and fair elections and ballot access. The campaign vows to continue to fight alongside the Wisconsin Green Party to regain its ballot status, which will require one percent of the statewide vote, or about 20,000 votes.

No 30-second answers, no sound-bytes, Donald Trump and Joe Biden would have to defend their positions against an incisive political mind.
Rogen made his offer on the media platform of another political-cultural talk host, Tim Kennedy.
Rogen and Kennedy are popular military veterans who host widely viewed political-cultural talk shows.

Biden and his consultants believe that because the former senator and vice president received free, tax-payer-financed healthcare for his family through the Federal Employees Health Benefits program, it follows that the American people should not be obtain the same tax-payer-financed healthcare for their families. Explains Joe Biden in his healthcare spot that seems to run as often in Wisconsin as Mike Lindell's My Pillow ads: "HealthCare is personal to me."
Joe Biden does not have to live with the same worries of working families.
Biden doesn't stress about deductibles, exclusions, massive debt and bankruptcies.
He just takes in corporate America's millions and screws American families, as Democrats say, thank you.
In his ad, Biden ironically takes a dig at health insurance companies, the same companies that finance his campaign for president and every elected office he has sought, more than any other Democratic Party candidate in 2019-2020, (In These Times).

Joe Biden has been in office for several decades so comparisons with the Trump administration should be formulated as Trump resembles Biden in considering policy stupidity in COVID 19 response.
The moratorium seems a rare bold, public health initiative. It's not and it exemplifies policy not even approaching half-measure value on a still-growing crisis.
What a massive stimulus bill should do to address this swath of policy is send federal money directly to landlords to pay for tenants in need of help.
The subsidy could can be free, or payback without interest or whatever. This would solve the problem for the tenants, the landlords, the banks and the coming worst-yet liquidity crisis.
In context, the moratorium is dishonest. Tenants in need are just pushing off eviction until after Jan 1 because after that they’ll be expected to come up with a pile of money for back-rent, penalties and they won’t have it.
If Trump were smart, he'd push, as he is able, a major stimulus legislation that includes a residential landlord stimulus.
But comprehensive public policy solving crises is not what Trump, Nancy Pelosi, Chuck Schumer and Joe Biden do.
They all play political games and likely Democratic Party officeholders will receive a new memo advising Dems to blame everything on the Russians.

Moreover, Mr. Obama has always been cleareyed about his friend’s vulnerabilities, urging Mr. Biden’s aides to ensure that he not 'embarrass himself' or 'damage his legacy,' win or lose.
When a Democratic donor raised the issue of Mr. Biden’s age late last year — he is 77 — Mr. Obama acknowledged those concerns, saying, 'I wasn’t even 50 when I got elected, and that job took every ounce of energy I had,' according to the person.
As Biden eschews unscripted appearances where he may have to think on his feet, the strategy of hiding the presumptive Democratic Party nominee for president is beginning to leak out.
Reading between the lines in the Times report, Obama appears more concerned about his personal legacy than seeing progressive change enacted. But I guess we already knew that.
The Democrats National Convention is six weeks out, and Party leaders are concerned about the presumptive nominee embarrassing himself, but not so concerned to do anything about it.
Sen. Kamala Harris' laughing at prosecuting California
parents for kids' tardiness or truancy.
The Joe Biden-corporate America campaign may be engaged in some misdirection in the veep-stakes.
But the fact that Biden has not ruled out Kamala Harris tells us much about Biden and the democrats: Defending wrongful convictions, throwing black and brown people in jail, and escalation of the drug war are who Joe Biden is.
Since declaring her campaign for president last year, Sen. Kamala Harris (D-CA) emitted policy stands with the authenticity of most other packaged liberal pols like Clinton, Biden or Kerry.
But in Harris' case, there was a vainglorious quality to this apparently deluded woman caught on videolaughing about how funny it was to send black and brown parents to jail when their children miss school.
"[A]s a prosecutor in law enforcement, I have a huge stick; the school has got a carrot, so let’s work in tandem around our collective objective and goal, which is to get those kids in school," said Harris in her infamous 2010 address to the Commonwealth Club.
Politicians are egotists, but Harris has convinced herself that using the state as a "stick" on parents of color makes her the right Democratic candidate for president, and for vice president.
Days before declaring her run for the presidency, Harris reflected on Jan. 21, 2019, "This is where it all began" at Howard University, the venerable institution where Harris says she became enthralled with the idea of becoming a prosecutor.
Anybody who dreams of becoming a prosecutor as a student is either obtuse, malicious or pathological.
America is a police-prosecutor-prison state that destroys lives, a perverse pursuit aimed especially at black and brown folks.
So, how did it all turn out for Harris after her start at Howard?
She became a prosecutor and California attorney general where she defended wrongful convictions, became a drug warrior and infamously became giddy on the 2010 campaign trail in recounting to the Commonwealth Club how she jailed the parents of students who were late or absent from school.
Democratic Party primary voters should watch this video below on The Young Turks discussing the Commonwealth Club appearance because, honestly, there is something wrong with a strutting candidate cackling about inflicting stress and prison onto low-income parents.
Harris' recounting of imprisoning parents is almost as disheartening as Trump throwing children into cages. Someone so out-of-touch with the struggles of low-income children, and so happy to use the state as a punitive stick against parents is someone for whom I'll never vote.
Video of Harris' laughter and narrative went viral last January; and Harris' broader record as a prosecutor is the subject of analyses by Briahna Gray in The Intercept, Lara Bazelon in the New York Times, Marie Gottschalk in In These Times and others.
[Harris is] running for president as a progressive, but as attorney general of California, she criminalized truancy — making it a crime for kids to be late for school and dragging into the criminal justice system even more disproportionately low-income, predominantly black and Latino families. She’s overlooked the misconduct of her prosecutors and fought to uphold their wrongfully secured convictions. She defended California’s choice to deny gender reassignment surgery to a transgender inmate, and in 2014, she appealed a federal judge’s holding that the death penalty was unconstitutional.
The list goes on and on. But in some ways, the details don’t matter. The problem isn’t that Harris was an especially bad prosecutor. She made positive contributions as well, encouraging education and re-entry programs for ex-offenders, for instance. The problem, more precisely, is that she was ever a prosecutor at all.
To become a prosecutor is to make a choice to align oneself with a powerful and fundamentally biased system.
That's right.
Why is it so funny to send parents with struggling children to jail? We have never had an explanation from Harris.
Coronavirus imperils Wisconsin as Gov Tony Evers
refuses action on elections to mounting criticism.
Update: Gov Evers' position remains let's hold the April 7 elections for in-person voting, and hope noone shows up at the poll because it's too dangerous.

One hell of a gamble with the safety of the Wisconsin people that Evers is taking.
But he has his reasons: Evers wants Wisconsin to not postpone elections, in accordance with the wishes of the national Democratic Party trying to shepherd establishment favorite, Joe Biden, as the nominee: "The Democratic National Committee (DNC) is asking states not to postpone their primaries amid the coronavirus pandemic," notes a reports from The Hill this weekend.
Public safety loses when matched against Party loyalty and group-think.

Madison, Wisconsin — With a flick of the state Health Sec-designee's
pen, Gov Tony Evers can ban the dangerous in-person voting scheduled
for Election Day, April 7, during this unprecedented state of emergency,
(Wisconsin Executive Orders).
But
Evers refuses to do so despite mounting criticism. Evers' staff says
moving elections would result in a lawsuit, so no public-safety order
from the administration, (Schmidt, Wisconsin State Journal).
A piece in the New York Times this morning makes the point:
With
April elections rapidly approaching in Wisconsin, local officials were
issuing stark warnings about holding in-person voting amid the
escalating coronavirus outbreak, saying the state was forcing voters to
choose between their health and their constitutional right to vote.
Wisconsin State Rep. David Bowen (D-Milwaukee), who tested positive for
COVID 19 this week, said at a press conference, "There is no safe way to
be able to have this election," (Becker, The Capital Times).
But
for Tony Evers, the Democratic Party needs justify his gamble that
noone shows up and votes in-person on Election Day — what Evers has been
urging for days.
And state Republicans are no better.

Even
as other states have postponed their presidential primaries, Evers has
remained adamant the election will proceed as planned on April 7 — a
decision that (State Sen) Fitzgerald (R) and (State Rep) Vos (R) have
supported. All three have strongly encouraged residents to vote
absentee.
The decision to hold the election at a time when
nonessential travel and mass gatherings are banned in hopes of
mitigating the respiratory disease’s spread has drawn strong criticism
from poll workers, clerks and members of the public who argue doing so
puts voters and poll workers at risk of infection.
Madison’s city
clerk has said roughly half of poll workers scheduled to work the
election have canceled. In Middleton, 25 of the city’s 72 poll workers,
including two chief inspectors, will not staff election day.
So what's with Evers and state Republican legislative leaders?
Republicans
want elections to proceed as they game public health to retain a
rightwing state Supreme Court justice in a depressed-turnout election.
And Evers wants the elections to proceed in defiance of the clear public health danger, to further the nomination of Joe Biden.
Holding elections during COVID 19 health crisis is like sailing in a hurricane

In Dane County, election officials are doing their best to ensure both a healthy and franchised electorate.
Still, the monster in the room looms large: COVID 19 on Election Day,
Municipalities are cutting back early voting as too dangerous for municipal bureaucrats and poll workers.
But surely, the danger on Election Day is equally hazardous for the public.
Wisconsin State Rep. David Bowen (D-Milwaukee), who tested positive for COVID 19 this week, said at a press conference, "There is no safe way to be able to have this election," (Becker, The Capital Times).
Rep. Bowen is right.
Evers is reportedly evaluating a mail-in-only election.
Changing the rules in the middle of the Election to henceforth ban in-person voting is a safer public health option.
But even during a state of emergency, declaring a major Election rules change is not going to pass Constitutional muster.
Evers is equivocating, emitting nonsense that "the message is still stay at home, vote by mail," (Becker, The Capital Times).
We don't and should not administer elections by "message" and public health advice.
"Pennsylvania lawmakers voted Wednesday to delay the state’s April 28 primary election by five weeks to June 2," joining 10 other states that are delaying elections, reads this morning's headline in Harrisburg.
Wisconsin should follow suit in canceling the April 7 elections, but wait to see if the public health situation clarifies before declaring another Election Day date.

Joe Biden has won 871 delegates (Bernie 719) out of a needed 1,991, (NBC News).
Next up are Arizona, Florida, Illinois (March 17), Alabama (March 31), Alaska, Hawaii, Louisiana (April 4) and Wisconsin, (April 7).
Bernie Sanders will win most or half of these states and likely blow Biden out in Wisconsin.
This will mean a few dozen delegates as the difference going into mid-April.
This will of course require Bernie's attack on Biden's hostility to Social Security and Medicare drawing blood in Florida.

Alan Simpson to co-chair the president's National Commission on Fiscal Responsibility, created in February 2010 via executive order. Simpson was one of Congress's most high-profile foes of entitlements and a proponent of Social Security privatization. Madison, Wisconsin — The 2019 campaign for the Democratic Party presidential nomination appears at a tipping point as major candidates call out the corrupt DNC-media system for its marginalization of progressive candidates and character assassinations spewed at a rate that makes Fox News blush.
"I don't know who the Democratic Party is. I just don't know who they are anymore," Terrance Warthen, co-chair of Our Wisconsin Revolution, (MSNBC), lamented in 2017.
It's worse now.
Progressive candidates — Tulsi Gabbard, Andrew Yang and Bernie Sanders — are alternately maligned and minimized in the corporate coverage though the three lead the field in championing the concerns of a solid majority of Americans.

Gabbard has perhaps the most compelling personal story. She enlisted in the Army after 911 and was deployed downrange, (Iraq 2004-05; Kuwait, 2008-09), "serving in a base in the Sunni Triangle at the height of the war[.] Tulsi had the heart-wrenching daily responsibility of going through the list of every injury and casualty in the entire theatre of operations, looking to see if any soldiers in her unit were on the list, so she could ensure they received the care they needed and their families were notified."
The Democratic National Committee and corporate media has become so brazen in their enmity towards progressive candidates that Tusli Gabbard preemptively boycotted the next DNC debate to be held on Dec 19.
For a number of reasons, I have decided not to attend the December 19th "debate" — regardless of whether or not there are qualifying polls. I instead choose to spend that precious time directly meeting with and hearing from the people of New Hampshire and South Carolina.
Several major candidates have already hit the DNC and its allied news network for their machinations in secretly choosing which polls decide who gets the free national air-time in the debates, and who gets blacked-out in continuing news coverage.

In case Kentucky voters did not get the message what Republicans stand for, six Mitch McConnell volunteers dressed in Team Mitch t-shirts posed for pictures of the young men groping, choking and assaulting an image of Rep. Alexandria Ocasio-Cortez (D-NY).
One young man grabbed Ms. Ocasio-Cortez' mouth in a simulated act depicting violent control over a woman prevalent in rape culture in which a woman is ordered to 'suck it.'

The McConnell's campaign's response made light of the simulated assault and mocked criticism: Team Mitch "in no way condones any aggressive, suggestive, or demeaning act toward life-sized cardboard cutouts of any gender," (Huffington Post).
Sexual assault and aggravated assaults are crimes now normalized in the Republican Party.
Kavanaugh was exposed as a rapist during his Senate confirmation hearings.
In the faces of the young Kentucky Republicans in Team Mitch's photos, it is easy to see a young Brett Kavanaugh, and other violent youthful Republicans who don't know enough not to treat fellow human beings as less than human.
Sexual assault, mass shootings and other violence do not come from nowhere.
Today, these crimes are legitimatized by a major American political party, the Republican Party, that mocks the idea that cultivating dehumanization of political opponents is unacceptable and indecent.
