Fed Appellate Judge Recants: We Blew Voter ID Opinion

Republican Party Voter Obstruction Project Could Be Heading for Trainwreck

Judge Richard A. Posner of the U.S. Court of Appeals for the Seventh Circuit (1981-present) is a sitting justice who writes a column for Slate Magazine and regularly intones on the abundant rightwing, judicial idiocies of our time.

In an amazing, audacious and perhaps bizarre interview featuring Posner and Mike Sacks (Host/Producer with HuffPost Live) first reported by Rick Hasen, Posner has recanted his 2007 decision in Crawford heard before the U.S. Court of Appeals for the Seventh Circuit, and authored by Posner, affirmed by the U.S. Supreme Court in 2008.

 "The purpose of the Indiana law is to reduce voting fraud, and voting fraud impairs the right of legitimate voters to vote by diluting their votes," Judge Richard Posner wrote in his majority opinion in 2007, affirmed by the U.S. Supreme Court in CRAWFORD v. MARION COUNTY ELECTION BD. (Nos. 07-21 and 07-25) (2008).

Posner has now publicly recanted his opinion.

The Brad Blog reports, "This is nothing less than remarkable. The 7th circuit court judge who wrote the majority opinion in the landmark Crawford v. Marion County Election Board case, has now admitted he got it wrong! 'I think we did not have enough information," Judge Richard Posner said in remarks today. "If the lawyers had provided us with a lot of information about the abuse of voter identification laws, this case would have been decided differently.'"

Posner made his comments in an interview with Mike Sacks discussing jurisprudence and Posner's new book, Reflections on Judging (Harvard University Press, 2013).

Writes Hasen:

In response to Mike Sacks’s questions about whether Judge Posner and the 7th circuit got it wrong in Crawford case, the one upholding Indiana’s tough voter id law against constitutional challenge (Posner says):

'Yes. Absolutely. And the problem is that there hadn’t been that much activity with voter identification. And … maybe we should have been more imaginative… we…. weren’t really given strong indications that requiring additional voter identification would actually disfranchise people entitled to vote. There was a dissenting judge, Judge Evans, since deceased, and I think he is right. But at the time I thought what we were doing was right. It is interesting that the majority opinion was written by Justice Stevens, who is very liberal, more liberal than I was or am ... But I think we did not have enough information. And of course it illustrates the basic problem that I emphasize in book. We judges and lawyers, we don’t know enough about the subject matters that we regulate, right? And that if the lawyers had provided us with a lot of information about the abuse of voter identification laws, this case would have been decided differently.'

Here’s the quote from Posner’s book, which Mike Sacks flashed on the screen: 'I plead guilty to having written the majority opinion (affirmed by the Supreme Court} upholding Indiana’s requirement that prospective voters prove their identity with a photo id—a law now widely regarded as a means of voter suppression rather than fraud prevention.'

The repercussions for protecting voter rights of Americans against the Republican and Tea Party are stunning.

The whole nationwide Republican Party project of obstructing the voting of Americans could be in dire jeopardy.

This is because Crawford is the landmark case that, for example, the Wisconsin DoJ, Scott Walker and even the historically (and formerly) non-partisan Wisconsin Legislative Reference Bureau (and every other GOP state hack) have hyped (erroneously) as the controlling legal case on challenges to the GOP's photo voter-obstruction statutes.

The Crawford case was challenged as unconstitutional on its face, so no evidence was presented demonstrating how voters were obstructed.

This lack of the evidence will not be a problem in Wisconsin.

In Wisconsin, two federal challenges to the state Voter ID law are set to heard on November 4: Frank v. Walker, (Case 11cv1128), (U.S. District Court for the Eastern District of Wisconsin) and Jones et al v. Deininger et al (Case 2:12-cv-00185), (U.S. District Court for the Eastern District of Wisconsin).

There is a mountain of social scientific evidence accumulated in Wisconsin Courts in state cases and by the federal plaintiffs demonstrating how voters were intended by this GOP legislation and the practice of the legislation to be obstructed from voting.

Look for a federal decision finding that Act 23, Wisconsin's Photo Voter ID law, is discriminatory and not supported by valid neutral justifications.

Brokaw, Wisconsin - Population 310
For 63 years, Brokaw, Wisconsin [Northern Wisconsin, population-310] native Ruthelle Frank went to the polls to vote. Though paralyzed on her left side since birth, the 84-year-old “fiery woman” voted in every election since 1948 and even got elected herself as a member of the Brokaw Village Board. But because of the state’s new voter ID law, 2012 will be the first year Frank can’t vote. Born after a difficult birth at her home in 1927, Frank never received an official birth certificate. Her mother recorded it in her family Bible and Frank has a certification of baptism from a few months later, along with a Social Security card, a Medicare statement, and a checkbook. But without the official document, she can’t secure the state ID card that the new law requires to vote next year.“It’s really crazy,” she added. “I’ve got all this proof. You mean to tell me that I’m not a U.S. citizen?” But state officials have informed Frank that, because the state Register of Deeds does have a record of her birth, they can issue her a new birth certificate — for a fee. And because of a spelling error, that fee may be as high as $200

Add Frank's to the stories of 96-year old Dorothy Cooper in TN who has voted in every election since woman were granted the right to vote, but who may longer be able to cast her vote on Election Day next year, and 86-year old WWII veteran Darwin Sparks in the same state; along with hundreds of thousands of others who are likely to find themselves unable to cast their legal vote on Election Day next year thanks to new voter suppression laws implemented in about a dozen states by GOP legislatures and governor's since they took control in 2010.

In Wisconsin, where "an estimated 177,399 Wisconsin residents 65 and older do not have a driver’s license or state photo ID — 23 percent of that population", and where Frank may have to pay as much as $200 to cast her legal vote under the GOP's new anti-democratic and anti-Democratic polling place Photo ID restrictions, the non-partisan League of Women Voters has filed suit charging the law to be in violation of the state's constitution, as The BRAD BLOG detailed in October. That case is still pending.

Stand with Don Siegelman

A critical victim of a banana-republic political persecution fights on—Donald Siegelman, former governor of Alabama (1999 to 2003).

We need to stand with Donald Siegelman, a victim of Karl Rove and the Bush Department of Justice.

Siegelman was convicted in 2007 on a charge of being a successful Democrat in Alabama, though the official charges are bribery and mail fraud. It's utter bull shit.

As Lou Debose writes:

The 2002 Alabama gubernatorial election included the plot elements of a bad Southern Gothic: a Klan rally in the backwoods; a political operative stealing the opposition's signs and planting them at the rally; a lawyer stalking and photographing the operative; incriminating photos used to extort a political candidate; and a cabal of lawyers maneuvering a man into the courtroom of a judge who promised to ‘hang’ the defendant. There was even a prosecutor ‘messing up’ the case to see that the defendant made it to the gallows.
Make no mistake, this was a Bush-league, third-world prosecution.

Asks Brad Friedman, “How it's even possible that former Alabama Governor Don Siegelman's bribery case and conviction has not long ago been dropped by the Dept. of Justice is beyond us?”

Writes Friedman:

In 2008, 52 former state attorneys-general, both Republican and Democratic, asked Congress to investigate the dubious prosecution of Siegelman. Last month, Karl Rove testified to the U.S. House Judiciary Committee behind closed doors, about this case, and others related to the U.S. Attorney Purge scandal. The information from that lengthy interview has not yet been released.

The government is required to file their brief in reply to Siegelman's new motion next week. He is currently free on probation, pending his ongoing appeal and now, potentially, new trial.

Friedman Rips Apart ACORN Voter Fraud Hoax

Brad Friedman eviscerates the GOP voter fraud lie aimed at the group ACORN, the Association for Community Organisations for Reform Now.

The crimes of ACORN are as Friedman writes in The Guardian:

... that Acorn managed to register some 1.3 (million) low-income (read: Democratic-leaning) voters over the past two years. The rest is, pretty much, just made up. ... Despite the screaming wall-to-wall coverage of 'Democratic voter fraud in 11 swing states' as seen on Fox News and even the once-respectable CNN, none of it's true
The fact that the GOP is simply engaging in another political lie (that shouted loudly and often enough may get to be heard) is known, but the media feels obligated to repeat GOP propaganda. Writes Friedman:

Acorn verifies the legitimacy of every registration its canvassers collect. If they can't authenticate the registration, or it's incomplete or questionable in other ways, they flag that form as problematic('fraudulent', 'incomplete', et cetera). They then hand in all registration forms, even the problematic ones, to elections officials, as they are required to do by law. In almost every case where you've heard about fraud by Acorn, it's because Acorn itself notified officials about the fraud that's been perpetrated on them by rogue canvassers. Most officials who run to the media screaming 'Acorn is committing fraud' know all of the above but don't bother to share those facts with the media they've run to. None of this is about voter fraud. None of it. Where any fraud has occurred, it's voter registration fraud and has resulted in exactly zero fraudulent votes.

The GOP has its marching orders and that is to scream fraud. Well, fraud is what we expect from that Muslim-city-slicking-Arab-black man's people.

Concludes Friedman:

And where (the GOP) can, they'll parlay it all into new photo ID restrictions at the polls (knowing full well that some 20 million, largely Democratic-leaning voters don't own the type of ID they'd need to jump over that next Republican hurdle.)

Wisconsin has seen this effort up close and personal.

Fortunately, Republican REAL ID legislative attempts have been knocked down by Gov. Doyle who vetoed REAL ID legislation, J.B. Van Hollen's suppression suit looks doomed, so all the GOP can do now is scream and try to smear Obama as $trillions in Americans' retirement savings go up in smoke.

'Gagged' FBI Whistleblower Says American Media Blacks Out 'Security of Americans' Story

Risking jail, gagged FBI whistleblower, Sibel Edmonds keeps trying to tell her story.

Edmonds was an FBI translator after 9/11 and was and remains gagged by the rarely-invoked "States Secret Privilege," invoked by the DoJ.
As the Brad Blog reports, "Her extraordinary story was first aired by CBS' 60 Minutes in 2002 (and re-run twice thereafter), and (run) via a detailed 2005 exposé in Vanity Fair."

Edmonds (pictured above-right) says the American corporate media has refused her offer to disclose classified information not before reported that includes allegations of criminal negligence and information concerning the "security of Americans," among other government crimes and incompetence.

Edmonds says several mainstream publications have been informed of the "full story" of administration and FBI misconduct and incompetence regarding 9/11 by other FBI leakers, but have killed stories on the matter.

The BRAD BLOG spoke recently with the legendary 1970's-era whistleblower in the wake of our recent exclusive, detailing Edmonds' announcement that she was prepared to risk prosecution to expose the entirety of the still-classified information that the Bush Administration has "gagged" her from revealing for the past five years under claims of the arcane "State Secrets Privilege".

I'd say what she has is far more explosive than the Pentagon Papers," Daniel Ellsberg told us in regard to former FBI translator turned whistleblower Sibel Edmonds.

"From what I understand, from what she has to tell, it has a major difference from the Pentagon Papers in that it deals directly with criminal activity and may involve impeachable offenses," Ellsberg explained. "And I don't necessarily mean the President or the Vice-President, though I wouldn't be surprised if the information reached up that high. But other members of the Executive Branch may be impeached as well. And she says similar (things) about Congress."
